E-Commerce. Our online sales and e-commerce services available via The Website are provided by us as an agent for third party suppliers. Where we are acting as a supplier for a third party the following conditions apply: (1) the contract will be directly between you and the third party for the services or goods in question. In the majority of instances, this will mean that there will be separate terms and conditions to govern the contract due to each third party suppler having its own terms and conditions relative to the services or goods in question. (2) we have no contractual liability to you in respect of any services or goods provided to you by a third party supplier. However we may be liable to you if we have been careless or neglectful, if we have misrepresented important information or if we have been in breach of any other relevant law.

E-Commerce. 40.1.1 The Parties will cooperate in performing their respective obligations under this Services Agreement in an electronic environment. This does not relieve either Party of its obligations under this Services Agreement.
E-Commerce. The Client acknowledges and agrees that unless expressly included in this Agreement and any relevant terms of use issued from time to time by Xxxxxx Xxxxxxx the requirements of the E-Commerce Directive (00/31/EC) as implemented in the United Kingdom are excluded to the extent permissible by law.
E-Commerce. Unless indicated in the proposal, this agreement does not contemplate an ecommerce enabled website, or any transaction that may require a secure server environment.
E-Commerce. All Revenues collected by either party from e-commerce offered on the Products not involving products or services of GEMS or its affiliates, shall be divided 90% to HealthGate and 10% to GEMS. Any Revenues collected by either party from e-commerce offered on the Products involving products or services of GEMS or its affiliates, for the first two and one-half years following the date of this Agreement, shall be retained 100% by GEMS, and any such Revenues collected after such two and one-half year period shall be divided as the parties negotiate in good faith considering (a) the level of effort expended by each party to enable such e-commerce, (b) prevailing market conditions, (c) comparable third party web-based distribution fees, (d) the price points of GEMS Products, (e) the volume of sales and (f) in no event shall be any less favorable to GEMS than the fees charged by HealthGate to others.
E-Commerce. The parties to this agreement will offer advanced courses in accordance with this written agreement. KDE programs of study will conform to the curriculum guidelines developed by the joint curriculum committee and will be available for review on the KDE website (xxxxxxxxx.xx.xxx). KDE further agrees that the Career and Technical Education Program of Studies will encourage the integration of technical and academic content in a meaningful, applied way, and that, when possible, instructors of all courses will implement applied teaching techniques as appropriate to classroom content. The parties agree that there will be no charge to students for any articulated credit covered in this agreement, either when the course is taken as a secondary student or when the student enrolls at Xxxxxxxx University transcription of these credits. The parties further agree that the KDE personnel and SU will maintain relationships that will permit continued development, refinement and implementation of all components of the program, including evaluation, marketing, counseling, recruitment and retention plans.
E-Commerce. For purposes of this Agreement, E-Commerce means transactions or sales between Academy and its customers conducted via the Internet, Academy’s websites, or any on-line system or computer network, as well as any related on-line, email, website, and other electronic marketing or advertising campaigns.

E-Commerce. (a) As used herein: (i) "AMEX E-Commerce Software" shall mean collectively, the High-End E-Commerce Software and the Low-End E-Commerce Software; (ii) "Commercially Viable" shall describe products and services that are generally commercially available and that are competitive in price and functionality with comparable products or services offered by third parties. (iii) "E-Commerce Authorization" shall mean the process via the Web for receiving approval from AMEX and other credit, charge, debit, stored valued and smart card issuers of E-Commerce Transactions pursuant to applicable card acceptance agreements between AMEX or such other issuers and Merchant Enrollees;
E-Commerce. 13. The working hours of the Online store are from 00:00 to 24:00. Terms for pick-up and / or delivery are from 9 am to 9 pm. 14. This Agreement is entered into between the Seller and the Buyer (hereinafter individually referred to as the "Contracting Party", collectively as the "Contracting Parties") when making any sale of items through the Online store. The contract is considered concluded if the following cumulative conditions are met: a. The Buyer has ordered items through his user account. b. The Buyer has confirmed that he agrees with this Agreement, by activating the appropriate link before ordering the item. c. The Buyer made the payment for the ordered items and received an invoice via e-mail confirming the place and date of delivery. 15. In terms of the provisions of this Agreement, ordering and selling items is done only and exclusively through the Online store (it is not allowed to order items by calling the call centre number 19995). 16. Shopping through the online store is only possible in quantities suitable for the household. If the ordered quantity is higher than the appropriate one, the Online store will automatically warn the Buyer about exceeding the allowed quantities, i.e. about the maximum allowed quantity. 17. The pictures of the items on the pages of the Online store are illustrative, and do not have to fully correspond to their actual appearance. The Seller guarantees that the items sold through the Online store are identical in their physical- chemical, biological, mechanical and other quantitative and qualitative characteristics to the items sold at other points of sale of the Seller. However, item information may not be complete. Data indicating nutritional value, raw material composition, allergens, etc. may vary from case to case. The Buyer is obliged to read the declaration carefully before using the item. 18. All prices in the Online store are expressed in Euro currency, with value added tax included, at the rate valid at the time of the payment transaction. Items are delivered at prices valid on the day of ordering, regardless of the selected delivery date. 19. The Seller reserves the right to change the price of an item, without prior notice. Items displayed in the Online store are part of the regular assortment of the Seller, but this does not mean that all items are available at any time, i.e. that they are in the Seller's warehouse.
