Common use of E-mail, Fax Machines, the Internet, and Intranets Clause in Contracts

E-mail, Fax Machines, the Internet, and Intranets. The Union and employees will not use state-owned or operated e-mail, fax machines, the Internet, or intranets to communicate with one another regarding union business. However, an employee may use state-owned e-mail to request union representation or to notify the Human Resources Office of their intent to distribute union material per Section 40.7. In addition, local union officers, shop stewards and union management communications committee members may use state owned/operated equipment to communicate with affected employees, the Union and/or the Employer for the exclusive purpose of administration of this Agreement. Such use will: 1. Result in little or no cost to the Employer; 2. Be brief in duration and frequency; 3. Not interfere with the performance of their official duties; 4. Not distract from the conduct of state business; 5. Not disrupt other state employees and not obligate other employees to make a personal use of state resources; and 6. Not compromise the security or integrity of state information or software.
