Effect of redistribution. (a) The Facility Agent must treat a redistribution as if it were a payment by the relevant Obligor under this Agreement and distribute it among the Lenders, other than the recovering Lender, accordingly. (b) When the Facility Agent makes a distribution under paragraph (a) above, the recovering Lender will be subrogated to the rights of the Finance Parties which have shared in that redistribution. (c) If and to the extent that the recovering Lender is not able to rely on any rights of subrogation under paragraph (b) above, the relevant Obligor will owe the recovering Lender a debt which is equal to the redistribution, immediately payable and of the type originally discharged. (d) If: (i) a recovering Lender must subsequently return a recovery, or an amount measured by reference to a recovery, to an Obligor; and (ii) the recovering Lender has paid a redistribution in relation to that recovery, each Finance Party must reimburse the recovering Lender all or the appropriate portion of the redistribution paid to that Finance Party, together with interest for the period while it held the redistribution. In this event, the subrogation in paragraph (b) above will operate in reverse to the extent of the reimbursement.

Effect of redistribution. (a) The Facility Agent must treat a redistribution as if it were a payment by the Company under this Agreement and distribute it among the Lenders, other than the recovering Lender, accordingly. (b) When the Facility Agent makes a distribution under paragraph (a) above, the recovering Lender will be subrogated to the rights of the Finance Parties which have shared in that redistribution by each Finance Party (other than the recovering Finance Party) assigning to the recovering Finance Party that part of its own corresponding claim hereunder which is allocable to its portion of the redistribution, and subsequently to such assignments being effected the Company will owe the recovering Finance Party a debt which is equal to the redistribution, immediately payable and of the type originally discharged.

(b) When the Intercreditor Agent makes a distribution under paragraph (a) above, the Recovering Creditor will be subrogated to the rights of the Creditors which have shared in that redistribution. (c) If and to the extent that the Recovering Creditor is not able to rely on any rights of subrogation under paragraph (b) above, the Borrower will owe the Recovering Creditor a debt which is equal to the redistribution, immediately payable and of the type originally discharged. (d) If: (i) a Recovering Creditor must subsequently return a recovery, or an amount measured by reference to a recovery, to the Borrower; and (ii) the Recovering Creditor has paid a redistribution in relation to that recovery, each Senior Creditor, on the request of the Intercreditor Agent, must reimburse the Recovering Creditor all or the appropriate portion of the redistribution paid to that Senior Creditor, together with interest for the period while it held the re-distribution. In this event, the subrogation in paragraph (b) above will operate in reverse to the extent of the reimbursement.

(b) When the ECA Facility Agent makes a distribution under Clause 17.2(a), the recovering ECA Lender will be subrogated to the rights of the Finance Parties which have shared in that redistribution. (c) If and to the extent that the recovering ECA Lender is not able to rely on any rights of subrogation under Clause 17.2(b), the Borrower will owe the recovering ECA Lender a debt which is equal to the redistribution, immediately payable and of the type originallydischarged. (d) If: (i) a recovering ECA Lender shall subsequently return a recovery, or an amount measured by reference to a recovery, to the Borrower; and (ii) the recovering ECA Lender has paid a redistribution in relation to that recovery, each Finance Party shall reimburse the recovering ECA Lender all or the appropriate portion of the redistribution paid to that Finance Party, together with interest for the period while it held the redistribution. In this event, the subrogation in Clause 17.2(b) will operate in reverse to the extent of the reimbursement.

In this event, the subrogation in sub-clause 33.2.2 above will operate in reverse to the extent of the reimbursement.
Effect of redistribution. (a) The Recovering CB Holder must treat a redistribution as if it were a payment by the relevant Obligor under this Agreement and distribute it among the CB Holders pursuant to Clause 13 (Partial Payments), other than itself, accordingly. (b) When the Recovering CB Holder makes a distribution under paragraph (a) above, it will be subrogated to the rights of the CB Holders which have shared in that redistribution. (c) If and to the extent that the Recovering CB Holder is not able to rely on any rights of subrogation under paragraph (b) above, the relevant Obligor will owe the Recovering CB Holder a debt which is equal to the redistribution, immediately payable and of the type originally discharged. (d) If: (i) a Recovering CB Holder must subsequently return a recovery, or an amount measured by reference to a recovery, to an Obligor; and (ii) the Recovering CB Holder has paid a redistribution in relation to that recovery,

(c) If and to the extent that the recovering Finance Party is not able to rely on any rights of subrogation under paragraph (b) above, the relevant Obligor will owe the recovering Finance Party a debt which is equal to the redistribution, immediately payable and of the type originally discharged.
