Effect of Review. Interconnected Transmission Owner's and Transmission Provider’s reviews of Interconnection Customer's initial drawings of the Customer Interconnection Facilities shall not be construed as confirming, endorsing or providing a warranty as to the fitness, safety, durability or reliability of such facilities or the design thereof. At its sole cost and expense, Interconnection Customer shall make such changes to the design of the Customer Interconnection Facilities as may reasonably be required by Transmission Provider, in consultation with the Interconnected Transmission Owner, to ensure that the Customer Interconnection Facilities meet Applicable Standards and, to the extent that design of the Customer Interconnection Facilities is included in the Facilities Study, to ensure that such facilities conform with the Facilities Study.

Effect of Review. Interconnected Transmission Owner’s review of Interconnection Customer's initial drawings of the Transmission Owner Interconnection Facilities that the Interconnection Customer is building shall not be construed as confirming, endorsing or providing a warranty as to the fitness, safety, durability or reliability of such facilities or the design thereof. At its sole cost and expense, Interconnection Customer shall make such changes to the design of the pertinent Transmission Owner Interconnection Facilities as may reasonably be required by Transmission Provider, in consultation with the Interconnected Transmission Owner, to ensure that the Transmission Owner Interconnection Facilities that Interconnection Customer is building meet Applicable Standards and conform with the Facilities Study.
Effect of Review. No investigation or review pursuant to Section 5.02(a) shall have any effect for the purpose of determining the accuracy of any representation or warranty given by any of the parties hereto to any of the other parties hereto.

At its sole cost and expense, Project Developer shall make such changes to the design of the Project Developer Interconnection Facilities as may reasonably be required by Transmission Provider, in consultation with the Transmission Owner, to ensure that the Project Developer Interconnection Facilities meet Applicable Standards and, to the extent that design of the Project Developer Interconnection Facilities is included in the System Impact Study(ies), to ensure that such facilities conform with the System Impact Study(ies).
Effect of Review. 5.1 Any review of and comment by the Owner on any Submittals are for general conformity to the obligations and requirements of this Agreement, and any such review and comment will not relieve the Design-Builder of the risk and responsibility for the Design and the Construction and for meeting all of its obligations and requirements of this Agreement, and will not create any new or additional obligations or liabilities for the Owner. Without limiting the generality of the foregoing any and all errors or omissions in Submittals or of any review and comment will not exclude or limit the Design-Builder’s obligations or liabilities in respect of the Design or the Construction under this Agreement or exclude or limit the Owner’s rights in respect of the Design and the Construction under this Agreement.

Effect of Review. Any Submitted Item which is returned or deemed to have been returned by the Authority's Representative endorsed "no comment" (and in the case of Reviewable Design Data, endorsed "Level A - no comment") shall be complied with or implemented (as the case may be) by xxxxx. In the case of any Submitted Item other than Reviewable Design Data, if the Authority's Representative returns the Submitted Item to hubco endorsed "comments", hubco shall comply with such Submitted Item after amendment in accordance with the comments unless hubco disputes that any such comment is on grounds permitted by this Agreement, in which case hubco or the Authority's Representative may refer the matter for determination in accordance with Schedule Part 15 (Dispute Resolution Procedure) and hubco shall not act on the Submitted Item until such matter is so determined or otherwise agreed. In the case of a Submitted Item comprising Reviewable Design Data, if the Authority's Representative returns the Submitted Item endorsed other than "Level A - no comment", hubco shall: where the Authority's Representative has endorsed the Submitted Item "Level B - proceed subject to amendment as noted", either proceed to construct or proceed to the next level of design of the part of the Works to which the Submitted Item relates but take into account any amendments required by the Authority's Representative in his comments; where the Authority's Representative has endorsed the Submitted Item "Level C - subject to amendment as noted" not act upon the Submitted Item, amend the Submitted Item in accordance with the Authority's Representative's comments and re-submit the same to the Authority's Representative in accordance with paragraph 4.4; and where the Authority's Representative has endorsed the Submitted Item "Level D - rejected" not act upon the Submitted Item, amend the Submitted Item and re-submit the Submitted Item to the Authority's Representative in accordance with paragraph 4.4,

Effect of Review. The Contractor’s safety obligations under this Contract will be in no way affected by any action or inaction by OPG with respect to any aspect of the Contractor’s or a Subcontractor’s safety program (including as part of OPG’s inspections or reviews), including any comment, review, action, or failure to do any of the foregoing.

At its sole cost and expense, New Service Customer shall make such changes to the design of the pertinent Direct Assignment Facilities and/or Customer-Funded Upgrades as may reasonably be required by Transmission Provider, in consultation with the Transmission Owner, to ensure that the Direct Assignment Facilities or Customer-Funded Upgrades that New Service Customer is building meet Applicable Standards and conform with the Facilities Study.
