Common use of Effect of Temporary Disability Clause in Contracts

Effect of Temporary Disability. A County employee who is entitled to temporary disability indemnity under Division 4 or 4.5 of the Labor Code may elect to take as much of his accumulated sick leave, or his accumulated vacation, or his accumulated compensable overtime, as when added to his disability indemnity will result in a payment to him of not more than his full salary or wage. When computing vacation, sick leave or overtime under this Article, the employee shall be given credit for any holidays that occur during the period of absence hereunder. Such employee is nevertheless entitled to medical, surgical and hospital treatment as provided in the Labor Code. When his accumulated sick leave, vacation or overtime, or all, are exhausted, he is still entitled to receive disability indemnity.
