ELECTION EXPENSES AND ALLOCATION OF COSTS. The participating authorities agree to share the costs of administering the Joint Election. Allocation of costs, unless specifically stated otherwise, is mutually agreed to be shared according to a formula which is based on the average cost per Election Day polling place (unit cost) as determined by adding together the overall expenses and dividing the expenses equally among the total number of polling places. Costs for polling places shared by more than one participating authority shall be pro- rated equally among the participants utilizing that polling place. It is agreed that charges for Election Day judges and clerks and Election Day polling place rental fees shall be directly charged to the appropriate participating authority rather than averaging those costs among all participants. If a participating authority’s election is conducted at more than one Election Day polling place, there shall be no charges or fees allocated to the participating authority for the cost of Election Day polling places in which the authority has fewer than 50% of the total registered voters served by that polling place, except that if the number of registered voters in all of the authority’s polling places is less than the 50% threshold, the participating authority shall pay a pro-rata share of the costs associated with the polling place where it has the greatest number of registered voters. Costs for Early Voting by Personal Appearance shall be allocated based upon the actual costs associated with each early voting site. Each participating authority shall be responsible for a pro-rata portion of the actual costs associated with the early voting sites located within their jurisdiction. It is agreed that the normal rental rate of ten percent (10%) for the County's voting equipment used on election day shall be charged and pro-rated among the participants utilizing each polling location. Costs for Early Voting by Personal Appearance shall be allocated as shown in Attachment " A" of this Contract.

The participating authorities agree to pay a flat fee of 5$ for the elections, as long as they do not request any additional Early Voting locations to be added to the list prepared by the Elections Administrator. If a participating entity requests to have one or more Early Voting locations added to the election, then such entity shall reimburse the county for the actual costs associated with the location. In addition, each participating authority agrees to pay the Tarrant County Elections Administrator an administrative fee equal to ten percent (10%) of its total billable costs (but not less than $ 75.00) in accordance with Section 31.100(d) of the Texas Election Code. The Tarrant County Elections Administrator shall deposit all funds payable under this contract into the appropriate fund(s) within the county treasury in accordance with Election Code Section 31.100.

Unless specifically stated otherwise, allocation of costs is mutually agreed to be shared. The County participates in "Vote Centers"; therefore, all political subdivisions can vote at any location. It is agreed that the standard rental rate charged for the County's voting equipment used on Election Day shall be calculated per polling location and among the participants utilizing each polling location. (See "Exhibit 1" for rental rates.) The total cost will be calculated and then multiplied by the Political Subdivision percentage number of registered voters or with the minimum of $2000.00; for those with a lesser amount, additional costs associated will be itemized and billed. Costs for Early Voting by Personal Appearance will also be charged with the same formula as Election Day. Those political subdivisions with a percentage of registered voters less than the amount equal to $2000.00 will be a minimum amount of $2000.00 for the early voting period. Political Subdivision conducting a runoff shall be responsible for all associated costs.

In the event of joint elections, it is agreed between all participating authorities to share the costs of administering the Joint Election. Any expenses incurred in the rental of polling location facilities shall be pro-rated among the participants to the Joint Election. It is agreed that the normal rental rate charged for the County’s voting equipment used on Election Day shall be pro-rated among the participants to this Joint Election. Each participating political subdivision shall share the cost and reimburse the County for the wages of Early Voting Election Clerks that are appointed and employed to work at the early polling locations. Each participating political subdivision agrees to reimburse the County for the wages for Election Day Judges and Clerks. Each participating political subdivision shall share the cost and reimburse the County for overtime wages at time and a half to the permanent employees of the Elections Administrator for contractual duties performed outside the normal business hours of the County in accordance with Section 31.100(e) of the Texas Election Code, as amended. Political Subdivision agrees to pay the County an administrative fee equal to ten percent (10%) of the District’s total proportionate share of the Election cost in accordance with Section 31.100(d) of the Texas Election Code, as amended. Estimated cost of services is stated in Attachment “A” hereto.

The Xxxxxx County Elections Administrator shall deposit all funds payable under this contract into the appropriate fund(s) within the county treasury in accordance with Election Code Section 31.100. Failure on the part of the Participating Authority to meet the deadlines outlined in this agreement may result in additional charges, including but not limited to, overtime costs for Xxxxxx County employees.

Costs for polling places shared by the County, Political Subdivision, and other political subdivisions shall be pro-rated equally among the participants utilizing that polling place. Any expenses incurred in the rental of polling place facilities shall be attributed directly to the participants utilizing that polling location. It is agreed that the normal rental rate charged for the County’s voting equipment used on Election Day shall be pro-rated among the participants utilizing each polling location. Costs for Early Voting by Personal Appearance shall be allocated as shown in Attachment C of this document. Political Subdivision agrees to pay Fort Bend County an administrative fee equal to ten percent (10%) of its total billable costs in accordance with Section 31.100(d) of the Texas Election Code.

XII WITHDRAWAL FROM CONTRACT DUE TO CANCELLATION OF ELECTION Political Subdivision may withdraw from this agreement and the Joint Election should it cancel its election in accordance with Sections 2.051 - 2.053 of the Texas Election Code. Political Subdivision is fully liable for any expenses incurred by Fort Bend County on behalf of Political Subdivision plus an administrative fee of ten percent (10%) of such expenses. Any monies deposited with the county by Political Subdivision shall be refunded, minus the aforementioned expenses and administrative fee if applicable.
