Common use of Election to Decline Recall Clause in Contracts

Election to Decline Recall. An employee with seniority may decline recall within the one (1) year recall period, when there are other employees eligible for recall who can satisfactorily perform the required work and report for work when required, subject to the following provisions: 1) If all those so eligible decline to report, the junior eligible employee will return to work or be considered as having voluntarily left the Company’s employment. 2) Subject to (3) below, an employee who has declined recall will not be eligible for recall nor is the Company obligated to contact him/her until the occasion of the next recall after he informs the Company in writing that he is available to report for work. 3) When no other employees who can satisfactorily perform the required work are eligible for recall the junior eligible employee will report when recalled or be considered as having voluntarily left the Company’s employment.
