ELECTRIC UTILITIES. The Licensor may estimate, acting reasonably the amount of electricity consumed by the Licensee which amount plus an administration fee of fifteen percent (15%) of the amount shall be paid by the Licensee when it is billed. Alternatively, where feasible, the Licensee may install a meter at its cost and in that case it will pay for its electricity consumption directly to the utility supplier. The Licensor shall use reasonable commercial efforts to notify the Licensee in advance of any planned utility outages that may interfere with the Licensee's Equipment use but shall not be responsible for any losses, costs or expenses suffered as a result of any such outages providing reasonable commercial efforts to provide advance notice of such planned utility outages were taken. The Licensor has no obligation to provide emergency or "backup" power to the Licensee. Any provision of emergency or "backup" power shall be the sole responsibility of the Licensee.
ELECTRIC UTILITIES. The Licensor shall estimate, acting reasonably, the annual amount of the Electrical Consumption Fee and deliver details of same to the Licensee on or prior to sixty (60) days in advance of the each annual anniversary of the Commencement Date. At the Licensor’s request, Licensee will provide Licensor with an electrical load calculation for Licensee’s Equipment, prior to installation or from time to time during the Term, to determine the total estimated annual cost of all electricity consumed in connection with the installation, operation and maintenance of the Licensee’s Equipment. If the electrical load calculation indicates that Licensee’s Equipment does not consume hydro, then the Electrical Consumption Fee may be waived by the Licensor, at its sole discretion. If the electrical load calculation indicates that Licensee’s Equipment is consuming hydro then such estimated annual cost shall be paid by the Licensee annually in advance in accordance with the Information Page. Licensor has the right to audit Licensee’s Equipment at any time to ensure that the Licensee’s power consumption is in accordance with its estimated electrical load calculation and may adjust the Electrical Consumption Fee charged in accordance with such audit. Alternatively, where feasible, the Licensee may install a meter at its cost (and as approved by the Licensor in accordance with Section 7) and in that case it will pay for its electricity consumption directly to the utility supplier. Alternatively, the Licensor may require the Licensee to be responsible for contracting with and procuring all electrical services, if any, which are necessary for the Licensee’s Equipment. Licensee shall pay for all costs of meters, sub meters, wiring, risers, transformers, electrical panels, lighting, air conditioning and other items, if any, required by Licensor which in Licensor's sole judgement, are necessary to accommodate Licensee's design loads and capacities, including, without limitation, the installation, operation and maintenance thereof. Notwithstanding the foregoing, Licensor may withhold consent for Licensee's installation of any wiring, risers, transformers, electrical panels, lighting, air conditioning systems, or other equipment if, in Licensor's sole judgement, acting reasonably, the same are not necessary or would cause damage or injury to the Building or cause or create a dangerous or hazardous condition or entail excessive or unreasonable alterations or repairs to the Building, or ...

ELECTRIC UTILITIES. You agree to (check one): Obtain electric service in the apartment suite in Your name; Pay a prorata share of electric service based on the number of tenants occupying the apartment suite.
a. If You choose to obtain electric service in your name: You understand and agree that there is only one electric meter serving the entire apartment suite, including Your Home, and You will be solely responsible to pay electricity for the entire apartment suite. You must obtain electric service in Your name prior to taking possession of the Home. Should You fail to do so, or in the event that payments for electricity are not made when due, either failure shall be considered Your default of this Agreement.
b. If You choose to pay a prorata share of electricity based on the number of tenants occupying the apartment suite: Pursuant to N.C. Gen. Stat. § 62-110(h), We shall obtain electric service in Our name, and We or our billing agent shall divide each monthly electrical xxxx for the apartment equally among all tenants residing in the apartment unit, and You agree that You shall pay Us (i) Your prorated share of said monthly electric xxxx, plus (ii) any additional administrative fees or costs approved by the N.C.

The Licensor has no obligation to provide emergency or "backup" power to the Licensee. Any provision of emergency or "backup" power shall be the sole responsibility and cost of the Licensee.
ELECTRIC UTILITIES. Licensee may use the Building's electrical power and connect Licensee's Equipment thereto at no charge provided the electrical power drawn does not exceed a 15 amp service. Otherwise, Licensee shall install, at its own cost, a separate electrical panel and meter for the Equipment in the Equipment Room and shall be responsible to the local electric utility for the electrical costs attributable to the use of such Equipment. Licensor shall use reasonable efforts to notify Licensee in advance of any planned utility outages that may interfere with Licensee’s use. Licensee further agrees that the Licensor has no obligation or responsibility to provide emergency or “backup” power to Licensee, and Licensee acknowledges that any such provision of emergency or “backup” power shall be the sole responsibility of Licensee.
ELECTRIC UTILITIES a. At the request of Licensor, Licensee shall pay the costs associated with installation of a separate electrical panel and meter for the Equipment and shall be responsible for any and all electrical and HVAC costs attributable to such Equipment. Licensee shall obtain Licensor's PRIOR written consent as to the location and method of installation as to its electrical panel, meter or electric or telephone utility lines. Licensor shall have no liability to Licensee if the electricity available to Licensee for the Equipment shall not be adequate to meet Licensee's needs.
b. Licensor shall use reasonable efforts to notify Licensee in advance of any planned utility outages which may interfere with Licensee's use, but in no event shall Licensor be liable to Licensee for any damages, direct or indirect, resulting from any loss of power. Licensee shall at all times be responsible for the provision of its own emergency or "backup power", and any such "backup power" system installed by Licensee shall be the sole responsibility of Licensee.
ELECTRIC UTILITIES. Irvine shall use all reasonable efforts to notify FirstWorld in advance of any planned utility outages which may interfere with FirstWorld's use, provided that Irvine shall incur no liability to FirstWorld for any failure to provide such notice. It is understood that neither Irvine nor FirstWorld has any obligation or responsibility to provide emergency or "back-up" power to FirstWorld, and that it is solely within FirstWorld's determination whether it elects to provide emergency or "back-up" power at its expense in any Building.
ELECTRIC UTILITIES. The Licensor may estimate, acting reasonably, the amount and cost of electricity consumed by the Licensee, or may determine the amount and cost through the use of a sub-meter, which cost plus an administration fee of fifteen percent (15%) of the amount shall be paid by the Licensee when it is billed. Alternatively, the Licensee may install a meter at its cost, subject to Licensor’s approval, which shall not be unreasonably withheld, and in that case it will pay for its electricity consumption directly to the utility supplier. The Licensor shall notify the Licensee forty-eight (48) hours in advance of any extended planned utility outages that may interfere with the Licensee’s Equipment use but shall not be responsible for any losses, costs or expenses suffered as a result of any such outages. The Licensor has no obligation to provide emergency or "backup" power to the Licensee. Any provision of emergency or "backup" power shall be the sole responsibility of the Licensee.
