Electromagnetic Fields. If Tenant at any time uses any equipment that may create an electromagnetic field exceeding the normal insulation ratings of ordinary twisted pair riser cable or cause radiation higher than normal background radiation, Landlord reserves the right to require Tenant to appropriately insulate the Lines therefore (including riser cables) to prevent such excessive electromagnetic fields or radiation.
Electromagnetic Fields. Lessor and Lessee hereby recognize and understand that the National Institute of Environmental Health Sciences (“NIEHS”) and the Department of Energy (“DOE”) has conducted research to understand the potential for health risks from exposure to extremely low frequency electric and magnetic fields (“ELF-EMF”), and that said research has lead the NIEHS and DOE to conclude: “Any scientific evidence to suggests that ELF-EMF exposure may pose health risk is weak (emphasis added).” Because ongoing public concern over safety due to ELF-EMF exposure has prompted more research in this area, which research may subsequently conclude that adverse health effects may result from ELF-EMF exposure, Lessee hereby agrees that it shall not be entitled to claim any breach of warranty of quiet enjoyment, or any and all other damages, claims or losses based upon claims of injury or otherwise due to ELF-EMF exposure, it being deemed a material representation on the part of Lessee, upon which Lessor relies in entering into this Lease, that Lessee hereby assumes the risk of any damage or injury to Lessee and to Lessee’s Employees flowing from ELF-EMF exposure. Lessor hereby represents and warrants that, to the best of Lessor’s actual knowledge as of the date hereof, Lessor has received no notice of any ELF-EMF exposure in the Building.
Electromagnetic Fields. There are no electrical ---------------------- transformers or electrical stations or substations within 100 yards of any portion of the Land.

Landlord shall include in the leases for all other tenants in the Project the same requirement to take protective measures with respect to their equipment. Notwithstanding the foregoing, it is the parties’ intent that the Building and Premises shall meet or exceed existing codes, and Tenant shall have no liability under the foregoing to the extent its equipment meets or exceeds existing codes.

If Tenant at any time uses any equipment that may create an electromagnetic field and/or radio frequency exceeding the normal insulation ratings of ordinary twisted pair riser cable or cause radiation higher than normal background radiation, Landlord reserves the right to require Tenant to appropriately insulate that equipment and the Lines therefor (including without limitation riser cables), and take such other remedial action at Tenant’s sole cost and expense as Landlord may require in its reasonable discretion to prevent such excessive electromagnetic fields, radio frequency or radiation.

IF TENANT AT ANY TIME USES ANY EQUIPMENT THAT MAY CREATE AN ELECTROMAGNETIC FIELD EXCEEDING THE NORMAL INSULATION RATINGS OF ORDINARY TWISTED PAIR RISER CABLE OR CAUSE RADIATION HIGHER THAN NORMAL BACKGROUND RADIATION, LANDLORD RESERVES THE RIGHT TO REQUIRE TENANT TO APPROPRIATELY INSULATE THE LINES THEREFORE (INCLUDING RISER CABLES) TO PREVENT SUCH EXCESSIVE ELECTROMAGNETIC FIELDS OR RADIATION." Exhibit C, Section 1 of the Lease "Rent" shall be amended by the addition of: "COMMENCING JUNE 1, 1997, THE BASE RENTAL RATE FOR THE PREMISES SHALL BE TWENTY-THREE DOLLARS AND FIFTY CENTS ($23.50) PER NET RENTABLE SQUARE FOOT PER ANNUM." Exhibit C, Section 3 of the Lease "Option to Extend Lease Term" shall be amended to read: "TENANT SHALL HAVE THE RIGHT, TO BE EXERCISED AS HEREINAFTER PROVIDED, TO EXTEND THE TERM OF THIS LEASE ("EXTENSION OPTION") FOR THE ENTIRE PREMISES INCLUDING ANY PORTIONS ADDED BY EXERCISE OF THE EXPANSION OPTION FOR ONE (1) PERIOD OF TWO (2) YEARS ..." A. NOTICE: UPON PROPOSING SUCH SPACE TO AN INTERESTED PARTY LANDLORD SHALL NOTIFY TENANT IN WRITING. Electromagnetic Fields. All power lines and electrical appliances and devices that draw electric current have electromagnetic fields (“EMF”) around them. Meritage has no expertise or information about EMF or the detection of EMF and does not review or monitor research efforts regarding EMF. Consequently, Meritage does not make any representations or warranties of any kind related to EMF. Rather, Buyer should contact its local electric utility company servicing the Home or its state or local environmental, energy, or health agencies, or the regional office of the Environmental Protection Agency to obtain such information.
Electromagnetic Fields. Lessee shall comply with all present and future laws, orders, and regulations relating to Electromagnetic Fields ("EMFs"), and the American National Standards Institute ("ANSI") standards. In addition to all other indemnification obligations of Lessee in this Lease, Lessee, on behalf of itself and its successors and assigns, shall indemnify, defend, and hold harmless Lessor from any and all costs, including reasonable attorneys' fees and costs, and claims of liability arising out of or related to the use of EMFs by Lessee at the Property.
