Eligible Properties. As of the Agreement Date, Schedule 6.1(x) is a correct and complete list of all Eligible Properties. Schedule 6.1(x) sets forth as of the Agreement Date whether such Eligible Property is a CBD or Urban Infill Property, an Acquisition Property or a Development Property. Each of the assets included by the Parent in calculations of Unencumbered NOI satisfies all of the requirements contained in the definition of “Eligible Property”.
Eligible Properties. Eligible properties are owner-occupied, principal residences that consist of one unit, including manufactured housing and units in condominiums and planned unit developments (“PUDs”) that conform with any related Xxxxxx Xxx requirements. Both existing structures and new construction are eligible, but cooperatives are ineligible.
Eligible Properties. The Parent shall not permit the number of Eligible Properties to be less than 10 at any time.
Eligible Properties. Cause all Collateral Pool Assets to continue to meet all the requirements included in the definition of "Eligible Property" hereunder (except for the condition regarding 60% occupancy in subsection (x) of those requirements).

Eligible Properties. 3.1 Expedited NRHP Evaluations
(a) Certain types of cultural resources are eligible for the NRHP because they obviously meet at least one of the NRHP criteria at 36 CFR 60.
Eligible Properties. The Borrower and the Guarantors own each of the Eligible Properties free and clear of all liens or encumbrances other than liens or encumbrances that secure indebtedness aggregating, in the case of any such Eligible Property, less than 30% of the annualized and normalized year-to-date Net Operating Income for such property capitalized at 12.0% at the time of determination. The Borrower has provided to the Banks true and correct and complete copies of all leases applicable to the Eligible Properties and neither the Borrower nor any Guarantor, knows of any present default (whether monetary or non-monetary) under or with respect to any of such leases. Each of such leases is in full force and effect and has not been modified or otherwise amended.
Eligible Properties. The Parent shall not permit the number of Eligible Properties to be less than 100 at any time.
(m) The Credit Agreement is further amended by restating subsection (i) of Section 10.3. thereof in its entirety as follows:
(i) with respect to clauses (a) through (d), those encumbrances or restrictions contained in (x) any Loan Document, (y) the Existing Term Loan Agreement or (z) any other agreement (A) evidencing Indebtedness that is not Secured Indebtedness which the Parent, the Borrower, any other Loan Party or any other Subsidiary may create, incur, assume or permit or suffer to exist under this Agreement and (B) containing encumbrances and restrictions imposed in connection with such Indebtedness that are either substantially similar to, or less restrictive than, the encumbrances and restrictions set forth in this Agreement;”
(n) The Credit Agreement is further amended by deleting the reference to $3,500 in Section 13.6.(b)(iv) and substituting in its place a reference to $5,000.
(o) The Credit Agreement is further amended by deleting Schedule I attached thereto in its entirety and substituting in lieu thereof Schedule I attached hereto.
Eligible Properties. The Parent shall not permit the number of Eligible Properties to be less than 35 at any time.
Eligible Properties. The Parent shall not permit the number of Eligible Properties to be less than 50 at any time.
