Common use of Employers Exempted Clause in Contracts

Employers Exempted. (a) Subject to an order of the Commission, in a particular redundancy case, clause 19 shall not apply to an Employer of fewer than 15 Employees. (b) Employees for the purpose of clause 19.11(a) shall be defined as the number of persons employed by the Employer when notice of the redundancy is given except for any casual Employee who has not been engaged by the Employer on a regular and systematic basis for at least 12 months.
