Environmental Laws and Licences. It and each of its Subsidiaries has:
(a) complied with all Environmental Laws to which it is subject;
(b) all Environmental Licences required in connection with its business;
(c) complied with the terms of those Environmental Licences; and
(d) complied with the terms of the Environmental Policy, in each case where failure to do so would be reasonably likely to have a Material Adverse Effect.
Environmental Laws and Licences. It and (in the case of the Company only) each other member of the Group has:
(a) complied with all Environmental Laws to which it may be subject;
(b) obtained all Environmental Licences required in connection with its business;
(c) complied with the terms of those Environmental Licences, in each case, individually or in the aggregate, where failure to do so would reasonably be expected to have a Material Adverse Effect.
Environmental Laws and Licences. Each Obligor shall:
(a) comply with all Environmental Laws to which it may be subject;
(b) obtain all Environmental Licences required in connection with its business; and
(c) comply with the terms of those Environmental Licences, in each case where failure to do so would reasonably be expected to have a Material Adverse Effect.
Environmental Laws and Licences. (a) Each Obligor shall (and the Company shall ensure that each other member of the Group will):
(i) comply with all Environmental Laws to which it may be subject;
(ii) obtain all Environmental Licences required in connection with its business; and
(iii) comply with the terms of those Environmental Licences, in each case where failure to do so would reasonably be expected to have a Material Adverse Effect.
Environmental Laws and Licences. (a) Except as disclosed in the notes to the unaudited quarterly consolidated financial statements of the Guarantor included in the Guarantor's Form 10-Q dated 14 November 2000 and filed with the Securities and Exchange Commission, it and each of its Subsidiaries has:
(i) complied with all Environmental Laws to which it is subject;
(ii) obtained all Environmental Licences required in connection with its business; and
(iii) complied with the terms of those Environmental Licences, in each case where failure to do so might have a Material Adverse Effect.
(b) Since the date of this Agreement, there has been no change in the status of the matters disclosed in the notes to the unaudited quarterly consolidated financial statements of the Guarantor included in the Guarantor's Form 10-Q dated 14 November 2000 and filed with the Securities and Exchange Commission that, individually or in the aggregate, has resulted in, or materially increased the likelihood of, a Material Adverse Effect.
Environmental Laws and Licences. Each Mining Obligor and each member of the Mechel Mining Group has:
(a) complied with all Environmental Laws to which it may be subject;
(b) obtained all Environmental Licences required in connection with its business; and
(c) complied with the terms of those Environmental Licences, in each case in circumstances where non-compliance (whether as a result of a single failure or otherwise) would be reasonably likely to have a Material Adverse Effect.
Environmental Laws and Licences. To the knowledge of the Company after due and careful enquiry, it and each of its Subsidiaries has (and each member of the Acquired Group has):
Environmental Laws and Licences. The Borrower shall:
(a) comply with all Environmental Laws to which it may be subject;
(b) obtain all Environmental Approvals required in connection with its business; and
(c) comply with the terms of those Environmental Approvals, in each case where failure to do so would reasonably be expected to have a Material Adverse Effect.
Environmental Laws and Licences. Except as disclosed in writing to the Agent before the date hereof, it and each of its Subsidiaries has:
(a) complied with all Environmental Laws to which it may be subject;
(b) obtained all Environmental Licences required in connection with its business; and
(c) complied with the terms of those Environmental Licences, in each case where failure to do so would be reasonably likely to have a Material Adverse Effect.
Environmental Laws and Licences. It has:
(a) complied with all Environmental Laws to which it may be subject;
(b) all Environmental Permits required in connection with its business;
(c) complied with the terms of those Environmental Permits; and
(d) complied with all other material covenants, conditions, restrictions or agreements directly or indirectly concerned with any contamination, pollution or waste or the release or discharge of any toxic or hazardous substance in connection with any real property which is or was at any time owned, leased or occupied by it or on which it has conducted any activity, in each case where failure to do so would reasonably be expected to have a Material Adverse Effect.
