Environmental Site Assessment Report. The Administrative Agent shall have received the Environmental Site Assessment Report.
Environmental Site Assessment Report. Borrower (at its own expense) shall have delivered to Lender not less than 15 Business Days prior to the date of the making of the Advance the most recent "Phase I" environmental survey in Borrower's possession of each Resort in form and substance acceptable to Lender.
Environmental Site Assessment Report. Lessor acknowledges receipt of, and its satisfaction with, the Environmental Site Assessment Report prepared for the Premises by GlenFos, Inc., Project No. P1-91311-092799, dated October 11, 1999 (the “Report”). The Report recommends no further subsurface investigation. Prior to the Start Date, Lessor shall remove from the Premises approximately eight (8) 55-gallon drums of liquid referenced in the Report. Lessee shall provide Lessor with a similar report made as of a date which is no earlier than ninety (90) days prior to the termination date of the Lease and Lessee’s vacancy of the Premises and Lessee shall deliver such report to Lessor no later than thirty (30) days prior to the termination date of the Lease and Lessee’s vacancy of the Premises.
Environmental Site Assessment Report. The Environmental Site Assessment Report dated August 4, 1998, prepared by Project Performance Corp. with respect to the Real Property.
Environmental Site Assessment Report. Except as may have been waived by the Lender, the Debtor (at its own expense) shall have delivered to the Lender not less than 10 Business Days prior to the Closing Date a Phase I environmental survey of the Hilltop Resort. The Phase I environmental survey shall provide that the Lender may rely thereon in connection with its making Advances hereunder.
Environmental Site Assessment Report. The Debtor shall have delivered to the Lender such Phase I environmental surveys of each Resort as Debtor shall have performed during the past three years or be in possession of as a result of another of its lenders commissioning same.
Environmental Site Assessment Report. The Borrower (at its own expense) shall have delivered to the Administrative Agent not less than 15 Business Days prior to the Closing Date a "Phase I" environmental survey of the Attitash Project, provided that if such "Phase I" environmental survey is not available or is unsatisfactory to the Administrative Agent (in its sole determination), the Borrower (at its own cost) shall have delivered to the Administrative Agent an engineering report or reports which shall be in form and substance satisfactory to the Administrative Agent and shall confirm the following items:
(a) the absence of Hazardous Substances on or under the Attitash Project and any portion thereof; and
(b) that the engineering firm has obtained, reviewed and included within its report a printout from the Comprehensive Environmental Response Compensation and Liability Information System of the Environmental Protection Agency and all other applicable state and local authorities and such other information as the Administrative Agent may reasonably require, all of which information shall confirm that there is no reason to believe that any Hazardous Substances exist on or under the Attitash Project and that there is no known or suspected Hazardous Substance waste site located at the Attitash Project or in such proximity thereto as to create a material risk of contamination of the Attitash Project. Each environmental survey and engineering report delivered pursuant to this Section shall provide that the Lenders may rely thereon in connection with its making Advances hereunder.

The Borrower (at its own expense) shall have delivered to the Administrative Agent not less than 15 Business Days prior to the Subsequent Project Advance Date a "Phase I" environmental survey of the Jordan Bowl Project, the Killington Project and the Mt. Snow Project, provided that if such "Phase I" environmental survey is not available or is unsatisfactory to the Administrative Agent (in its sole determination), the Borrower (at its own cost) shall have delivered to the Administrative Agent an engineering report or reports which shall be in form and substance satisfactory to the Administrative Agent and shall confirm the following items:
(i) the absence of Hazardous Substances on or under the Jordan Bowl Project, the Killington Project and the Mt. Snow Project and any portion thereof, respectively; and
(ii) that the engineering firm has obtained, reviewed and included within its report a printout from the Comprehensive Environmental Response Compensation and Liability Information System of the Environmental Protection Agency and all other applicable state and local authorities and such other information as the Administrative Agent may reasonably require, all of which information shall confirm that there is no reason to believe that any Hazardous Substances exist on or under the Jordan Bowl Project, the Killington Project and the Mt. Snow Project and that there is no known or suspected Hazardous Substance waste site located at the Jordan Bowl Project, the Killington Project and the Mt.
