Escaped Prescribed Fires. Wildfires resulting from escaped prescribed fires that were ignited by, managed at the direction of, or under the supervision of one of the Parties to this Agreement shall be the responsibility of the Jurisdictional Agency. If the Parties to this Agreement jointly conduct or manage a prescribed fire, the responsibility for suppression costs, should it escape, shall be agreed upon and documented in the Project Plan. Unless otherwise agreed, all suppression costs and associated damages are the responsibility of the Jurisdictional Agency. The Parties to this Agreement will not hold each other responsible under this clause for escaped prescribed fires originating on private land, or on state or federal lands not protected by one of the Parties to this Agreement.

Escaped Prescribed Fires. If a prescribed fire is declared a wildfire, the Protecting Agency FMO will assume operational control with the cooperation of Jurisdictional Agency and the Burn Boss. A wildfire number will be assigned and all wildfire management costs will be charged to that number. The same analysis and decision support documentation that applies to all wildfires is required. The acreage burned after the fire was declared a wildfire is reported as wildfire acreage in the final fire report. Reference Clause 29 below for the requirements for the decision process. As dictated by individual agency policy, the Jurisdictional Agency administrator is responsible for conducting the appropriate level of investigation when a prescribed fire is declared a wildfire.

Escaped Prescribed Fires. If a prescribed fire escapes the planned burn unit yet remains solely on the lands of the jurisdictional agency that is implementing the prescribed fire; a Cost Share Agreement should not be required. A Cost Share Agreement should only be required when the escaped fire leaves the jurisdictional lands of the agency that was implementing the prescribed fire. A cost share agreement will be done immediately once a prescribed fire is declared as escaped. See Master Agreement, IX. Operations, Clause 5. Escaped Prescribed Fires.

The signatories to this Operating Plan will not hold each other responsible under this clause for escaped prescribed fires originating on private land, or on state or federal lands not protected by one of the signatories to this agreement.

Escaped Prescribed Fires. Wildfires resulting from escaped prescribed fire ignited by a party to this Agreement on lands it manages shall be the responsibility of that party. The party responsible for the prescribed fire will reimburse other parties to this Agreement, consistent with the terms and conditions contained herein, for all suppression costs of Assisting Agencies and Counties. In all cases, however, the payment of such claims by an Agency of the State of Kansas shall be limited to that amount as ultimately determined by a court of competent jurisdiction under applicable state or federal law. Escaped prescribed fires ignited by individual(s) not party to this agreement will be considered as wildfires under the terms and conditions of federal and State law.
