As used in this Contract, excessive damage occurs where either: (1) 5% or more of the individual trees in the sale area are damaged, and/or (2) Bark removal on tree xxxxx or main stems sum more than 200 square inches per acre in the sale area. For purposes of this determination, all debarked patches greater than 1 square inch on trees larger than 5 inches DBH are considered.
EXCESSIVE DAMAGE. Upon written notice from the Bethlehem Township Trustees that excessive damage has occurred because of Operator’s transportation of equipment or materials or failure to promptly or adequately repair road damage due to pipeline installation or maintenance, Operator will immediately make additional necessary improvements to strengthen the road base and surface. All hauling permits for use by Operator of township ROADS will be suspended until repairs are done to correct the excessive damage.

EXCESSIVE DAMAGE. If the Building or Premises is damaged or destroyed to the extent that the Premises or Building cannot, in Landlord's sole judgement, be fully repaired or restored by Landlord within one hundred eighty (180) days after the date of the damage or destruction, Landlord may terminate this Lease by providing Tenant written notice of Landlord's election within sixty (60) days after the damage or destruction.
EXCESSIVE DAMAGE. Where the damage deposit is insufficient to fully cover the amount of damages to the hall or the equipment, the Renter agrees to pay the Strathearn Community League the full cost of repairs over and above the damage deposit. The Strathearn Community League shall determine the cost of the repairs and shall provide written notice of the balance owing to the Renter no later than fourteen (14) days following the rental date. The balance owing immediately becomes due and payable upon receipt of the written notice.
