Excluded Products. The following are excluded from the scope of this Contract: 1. Sourced products or related services which may be referred to as open market items or non-standard options; and 2. Leased products. This document sets forth the terms and conditions governing acquisitions under this Piggyback Contract for use by Authorized Users. All the terms, conditions, covenants and representations contained herein and in the Master Contract, except as modified by this Piggyback Contract, are hereby incorporated by reference and deemed to be a part of this Piggyback Contract as if fully set forth at length herein. The terms and conditions of this Piggyback Contract shall supersede any conflicting terms and conditions set forth in the Master Contract. The Master Contract is expressly amended as noted in Section 4, Merger of Appendices/Conflict of Clauses, below.
Excluded Products. All products now or hereafter produced by the Company that are not Products.
Excluded Products are specifically excluded from the Volumes required to be purchased or supplied under this Agreement.

Talking household products to assist the blind (i.e. microwave ovens and other small appliances, watches, scales, clocks). 4. Vibrating or flashing household items to assist the deaf (i.e. alarm clocks, bed shakers, watches) 5. Software that is included on the New York State Prohibited Software List, (other then pre-loaded operating systems software for IMS), or does not satisfy the definition of Related Software. 6. Individually sold IMS components, parts and accessories which do not fall under the scope of Product Type A (i.e. Microcomputer Systems, printers, scanners), unless sold as upgrades/replacement parts for a previously provided IMS. 7. Supplies for printers and other Microcomputer System peripherals that are not designed specifically to assist persons with disabilities (i.e. printer toner, non-specialty paper), except for the starter supply that is included with the initial IMS purchase. OGS reserves the right, at its sole discretion, to expand or limit the above list of excluded products, to deny the inclusion of any products, or request the removal of previously approved products.
Excluded Products. For the avoidance of any doubt, the rights granted in Paragraph 1(a) and (b) shall be specifically limited to the Wireless Products for the Wireless Platform and shall not extend to any other device, platform, operating system or distribution method, whether wired or wireless, pursuant to which interactive entertainment software may be delivered to or accessed by end-users, including, but not limited to, the following: (i) traditional entertainment software console platforms, such as Sony PlayStation and PlayStation 2, Microsoft Xbox, and Nintendo GameCube and successor platforms; (ii) desktop or laptop computer systems, such as PC Windows, Macintosh, (iii) hand-held electronic dedicated gaming devices (e.g., Nintendo’s GameBoy Color and GameBoy Advance handheld devices, Sony’s PSX handheld device, and Tiger Electronic hand-held devices); (iv) pay-per-play arcade systems and other forms of location-based entertainment; (v) interactive toys; (vi) television, whether via cable, satellite, set-top boxes or other on-demand service; (vii) massively multiplayer games; (viii) internet gaming and (ix) any other technology now known or hereafter devised. Except as otherwise specifically stated herein with respect to the Wireless Products, Licensee shall have no right to develop, manufacture, reproduce, distribute, sell or exploit any other products based on the PSM or the Property.
