Expediting. If at any time it becomes apparent to Buyer that the Goods will not be delivered by the date(s) specified in the Agreement, then Buyer may require Seller to expedite the work (including by adding additional shifts and equipment or by subcontracting), and any additional costs will be borne by Seller.
Expediting. When an expedited shipping fee is pre-approved in writing by Buyer and charged by Seller, Seller shall assure delivery on or before the specific delivery date required by Buyer. If delivery is not made on or before the specific delivery date, the expedited shipping fee shall not be due or payable by Buyer.
Expediting. This Agreement is subject to expediting by Voith and/or its authorized representative, and expeditors shall be allowed free access to all phases of manufacture and supply, including, without limitation, shipping details. Upon notice, Vendor shall promptly provide Voith’s expeditor with the name of a plant contact, plant reference number, scheduled holidays and shut-down periods, plant capacities and current workload, numbers of Vendor’s personnel qualified in various disciplines having to do with execution of this Agreement and any other pertinent information. Voith’s expeditor will monitor the timely preparation of and Vendor’s actual adherence to the schedule covering activities in engineering, issuance of drawings and data, material acquisition, fabrication, assembly, inspection, testing and shipping. Notification of readiness for inspection and/or testing shall be given in writing to Voith. If requested by Voith, Vendor shall make available at its cost working facilities for a resident expeditor from Voith, including, but not limited to, office space, telephone, computer, etc.
Expediting. The goods and services shall be subject to expediting by Buyer or its representatives. Buyer’s personnel shall be allowed reasonable access to Seller’s plants for the purpose of expediting and/or inspection.
Expediting. The goods furnished under the Purchase Order shall be subject to expediting by Buyer or its representatives. Buyer’s personnel or its representatives shall be allowed reasonable access to Seller’s plants, and those of his sub−suppliers, for expediting purposes. As required by Xxxxx, Seller shall supply schedules, progress reports, and unpriced copies of sub−orders for Xxxxx’s use in expediting.
Expediting. The goods furnished under this Agreement shall be subject to expediting by MTS. MTS shall be afforded free access to Contractor's shops, factories, or places of business, and those of Contractor's suppliers, for expediting purposes. As required by MTS, Contractor shall supply schedules, unpriced copies of purchase orders and progress reports for MTS's use in expediting.
Expediting. 1. Supplier understands that time is of the essence. Supplier agrees to comply with the specific delivery schedule set forth in the Purchase Order and to provide R-S Matco expedited delivery as requested by R-S Matco R- S Matco may cancel this order with no costs, charges, or penalties, notwithstanding provisions of Article VI, if R-S Matco’s specified delivery date cannot be met due to Supplier’s, or Supplier’s sub-contractors, sub- suppliers or agents, failure to perform under such Purchase Order. R-S Matco may, with reasonable notice, suspend delivery schedules in the Purchase Order. Should Supplier be unable to meet the delivery schedule set forth in the Purchase Order, R-S Matco may, at its sole discretion, purchase the Products elsewhere and Supplier shall be responsible for any additional costs of said purchase.
2. If Supplier fails to deliver the Products within the time specified in the Purchase Order the actual damage to R-S Matco for the delay will be difficult or impossible to determine. Therefore in lieu of actual damages Supplier will pay to Buhlmann as fixed, agreed and liquidated damages an amount equal to 0,3% of the value of the Purchase Order for each calendar day which shall elapse between any delivery date specified and the actual date on which the Supplier completes the delivery. Without prejudice to other remedies of R-S Matco available at law or in equity notwithstanding the foregoing if R-S Matco elects to obtain substitute product as set forth in Section XI.1 then Supplier will be liable for such liquidated damages accruing until such time as R-S Matco obtains delivery of such substitute goods, in addition to excess of re-procurement.
3. If Supplier is able to prove that the actual damage incurred by Xxxxxxxx is lower than the liquidated damages due in accordance with article IX.2., Supplier’s liability shall be reduced to the actual damage.
Expediting. 2.8.1 The Contractor shall act immediately to procure and furnish all requisite Materials and Equipment necessary for the Contractor to commence deliveries and start the Work at the Project immediately upon the Commencement Date. The Contractor shall make deliveries of all such Materials and Equipment to the Project Site at such times (including overtime days or hours if necessary) so as to avoid delays to the Work or the Project.
2.8.2 The Contractor shall furnish and shall direct its Subcontractors to furnish such information to the Owner and the Owner’s Representative as the Owner and the Owner’s Representative may require regarding deliveries and production and in connection with the expediting of the Project.
Expediting. Expediting personnel shall be assigned according to requisition volume, complexity, and specific situations that may arise. Responsibilities shall include: • Monitoring and expediting subcontractors’ and suppliers’ submittals • Monitoring and expediting subcontractors and suppliers, as necessary, to ensure delivery of Equipment in accordance with project requirements • Periodically reporting the manufacturing and delivery status of Equipment
Expediting. The Procurement Plan identifies critical equipment needing special expediting and tracking. Expediting begins with contacting the vendor to confirm that he has entered the CONTRACTOR order into the vendor’s manufacturing/supply program. Expediting continues with the checking of status of vendor engineering, procurement, manufacturing and shipping. CONTRACTOR expedites the review and return of reviewed vendor drawings and data. Comments from vendor data reviews will be transmitted to the vendor by e-mail and/or via courier. Expediting continues until equipment has been received on site. Equipment deliveries will generally not be contingent on drawing reviews so the vendor may order critical raw materials as soon as he receives CONTRACTOR’s purchase order. Expediting of spare parts parallels the expediting of the equipment for which the parts are ordered. Major problems, which cannot be effectively resolved via fax or telephone, may require visit(s) to the vendor’s shop. CONTRACTOR can send copies of all Expediting Reports and shop visits to OWNER.
