Facility Document Clause Samples

Facility Document. It is acknowledged and agreed by each of the parties to this Deed that from the date of this Deed, this Deed shall constitute (i) a Facility Document as defined in the Project Loan Agreement, (ii) a Facility Document as defined in the Bank Loan Agreement, (iii) a Project Facility Document as defined in the Bank Loan Agreement, and (iv) a Bank Document as defined in the Project Loan Agreement.

Facility Document. The Parties designate this Deed as a Facility Document.

Facility Document. No failure on the part of the Agent or any Bank to exercise, and no delay in exercising, any right hereunder or under any other Facility Document shall operate as a waiver thereof or preclude any other or further exercise thereof or the exercise of any other right. The remedies herein provided are cumulative and not exclusive of any remedies provided by law.

Facility Document. Each party hereto acknowledges and agrees that this Amendment shall be a Facility Document.

Facility Document. This paragraph (b) shall not apply to the extent a loss, liability or cost is compensated for by an increased payment under clause 15.2 or paragraph (a) above.

Facility Document. 6.1 The Parties designate this Agreement as a Facility Document. 6.2 The Parties agree that any provision of the Committed Facility Letter that applies to a Facility Document shall apply to this Agreement as if set out in full in this Agreement (save to the extent that such provision would be inconsistent with the terms of this Agreement) and so that references in any such provision to: (a) “this Agreement”, “the Facility Documents” or a “Facility Document” shall be construed so as to include this Agreement; and (b) “the Parties” or a “Party” shall be construed as references to the parties or a party (as the case may be) to this Agreement.

Facility Document. This Agreement shall constitute a "Facility Document" for purposes of the Facility Agreement and the other Facility Documents.

Facility Document. This Amendment shall be a Facility Document for all purposes.

Facility Document. This Waiver shall constitute a Facility Document under the terms of the Credit Agreement.
