Facility Expansion. 4.1.6.1 If a Major Gas Sale is Sanctioned by year-end 2019, then the WIOs are not obligated to pursue or continue to pursue the work plans for a Point Thomson Expansion Project set forth in Paragraphs 4.1.6.2, 4.6.2, or 4.6.3.
4.1.6.2 If a Major Gas Sale is not Sanctioned by June 1, 2016, the WIOs shall begin engineering and permitting of a Point Thomson Expansion Project. The WIOs shall incorporate these work plans into the Expansion Planning POD set forth in Paragraph 4.6.2 of this Agreement.
Facility Expansion. 18.07.01 Anam agrees that it will not expand the Facility or the Capacity without advanced, prior written notification to TI, which notification shall provide in detail plans for any such expansion, including anticipated additional Capacity.
18.07.02 Anam shall provide TI with the right of first refusal to any such additional Capacity in accordance with TI's loading rights pursuant to Article 8.00 of this Agreement, provided however, TI shall have the right not to load such additional Capacity, in part or in whole, in accordance with Section 8.01.01, in which such case, Anam shall be responsible solely for filling any such additional Capacity; and further provided, all other terms and conditions of this Agreement shall apply to such additional Capacity.
Facility Expansion. If Ford elects to expand, add on to, or develop a new structure on the Land, UDOT shall perform and complete the work required for such expansion, addition or new building (“Expansion Work”). Ford and UDOT shall negotiate in good faith the required new terms and costs for such Expansion Work.
Facility Expansion. For any Facility expansion, upload a one-line diagram that demonstrates the total (existing plus new) Facility’s capacity. If the existing Facility does not have a MassACA net metering cap allocated and the ISA only lists the new Facility’s capacity, please upload either the Permission to Operate or ISA for the existing Facility.
Facility Expansion a. For the purpose of planning timely additions to the North American’s Facilities, Charlotte County and North American shall meet from time to time to determine when additional Landfill Gas flow may become available.
b. The County has no obligation to fund expansion of the Collection System except as is required by law. North American at its option may fund expansions to the Collection System.

At any time during the Agreement Term, neither Seller nor any Affiliate of Seller shall, without the prior written consent of Buyer, which Buyer may withhold in its sole discretion, install equipment on the Premises in addition to the equipment included in the original Facility for the purpose of increasing the capacity of the Facility to more than two hundred (200) MW.
