Common use of Failure to Appeal Clause in Contracts

Failure to Appeal. The failure of any employee to appeal a grievance to the next level within the time limits specified above shall bar further appeal, provided however, the failure of the Employer’s specified representatives to answer a grievance within applicable time limits, shall constitute a denial and permit appeal to the next level, and provided further any such time limits may be extended by mutual agreement.
