Common use of Federal and State Law Control Clause in Contracts

Federal and State Law Control. The Trust managed by the Trustee is a pooled trust, governed by the laws of North Dakota Century Code §59-08-02 and applicable Federal laws and regulations. To the extent there is a conflict between the terms of this Joinder Agreement or Pooled Trust and the governing law, the law and regulations shall control. The Trustee may amend the Pooled Trust and/or this Joinder Agreement from time to time in its discretion to meet the requirements of applicable law.
