Fiber Optic Cable. After the Commencement Date, Landlord shall cooperate with Tenant to secure fiber optic cable to the MPOE in the Building. Tenant shall be responsible at its expense for executing a service contract with a fiber optic vendor and paying all costs of installation, service, maintenance, operation, repair and removal of the fiber optic cable; provided, however, that Tenant shall not execute such service contract until it has been reviewed and approved in writing by Landlord, which approval shall not be unreasonably withheld or delayed. Landlord disclosed to Tenant that Landlord previously obtained a bid offer from XO COMMUNICATIONS to install a fiber optic feed to the Building’s MPOE at no installation cost or expense, provided the user executes a service contract for an initial term of at least three (3) years and a monthly service fee of $2,200.00. EXCEPT AS HEREBY AMENDED, all other provisions of the Lease are hereby confirmed and ratified.
Fiber Optic Cable a. TDI-NE shall convey to VTrans the ownership of all the dark fiber installed as part of the Project (“Project Fiber”) that TDI-NE determines, in its sole discretion, is not directly needed by TDI-NE to operate its facility and therefore are incidental to the project (“VTrans’ Fiber”). TDI-NE expressly disclaims any commercial interest in the leasing, sale or commercial operation of any of the fiber optic cable it installs as part of the Project for any purpose other than the direct operation of its facility. At the present time TDI-NE anticipates needing eight (8) strands but may determine to utilize additional strands. VTrans understands that TDI-NE has made informal agreements with Green Mountain Railroad Corp. (“GMRC”) and Vermont Electric Cooperative (“VELCO”) to require VTrans to convey some fiber optic cable to those entities for the direct operation of their facilities and VTrans agrees to make reasonable efforts to negotiate contractual terms with those entities, including terms providing fiber optic cable to those entities solely for the direct operation of their facilities at cost with no markup.
b. TDI-NE plans to install the Project Fiber as a single fiber optic bundle as a component of its Section 248 petition in order to utilize the fiber strands for the Project as noted above. The Parties acknowledge, however, that 30 VSA Section 248 does not expressly authorize the installation of any facilities not otherwise required to construct or operate TDI’s facility. The Project requires fiber from a Converter Station in Canada through Lake Champlain to a Converter Station in Ludlow, VT (the “Fiber Route”) and does not require any “fiber off-ramp facilities” along the route. TDI-NE will install the Project Fiber along the upland Fiber Route through the Town of Alburgh from the Canadian border to Lake Champlain, a distance of approximately one-half of a mile.
c. Subject to TDI-NE’s final engineering, and with due consideration to be given to VTrans’ specifications for the fiber optic cable, TDI-NE will install fiber optic cable from Xxxxxx to the Ludlow converter station using an industry standard 528 fiber strand fiber optic cable (or a similarly sized cable depending upon market availability) in a 2 inch or greater HDPE conduit. Fiber Optic Cable. (a) The Transmission Facilities will include a fiber optic cable between the interconnections with National Grid’s transmission facilities in Narragansett, Rhode Island and New Shoreham, Rhode Island (the “Fiber Optic Cable”). Subject to the Transmission Facilities being placed into service and subject to Section 6(b) below, National Grid will provide access to a minimum of 12 fiber pairs of the Fiber Optic Cable to DWBI and a minimum of four (4)fiber pairs of the Fiber Optic Cable to the Town of New Shoreham, Rhode Island, in each case at a cost of $1.00 per annum and upon the terms and conditions in a mutually acceptable fiber use agreement, which each of DWBI and the Town of New Shoreham will be required to execute in order to receive such access to the fiber optic cable under this Section 6.
(b) THE CAPACITY ON THE FIBER OPTIC CABLE IS PROVIDED TO DWBI AND TO THE TOWN OF NEW SHOREHAM “AS IS” AND “WHERE IS.” NATIONAL GRID DOES NOT MAKE, AND SHALL NOT BE DEEMED TO HAVE MADE, AND HEREBY EXPRESSLY DISCLAIMS, ANY REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, AS TO THE VALUE, CONDITION, DESIGN, OPERATION, PRIOR USE, MERCHANTABILITY OR FITNESS FOR USE FOR A PARTICULAR PURPOSE OF THE FIBER OPTIC CABLE, AS TO THE ABSENCE OF ANY LATENT OR OTHER DEFECTS, WHETHER OR NOT DISCOVERABLE, AS TO THE ABSENCE OF ANY INFRINGEMENT OF ANY PATENT, TRADEMARK OR COPYRIGHT, AS TO THE ABSENCE OF ANY OBLIGATIONS BASED ON STRICT LIABILITY, LIABILITY IN TORT, OR ANY OTHER REPRESENTATION OR WARRANTY WHATSOEVER, EXPRESS OR IMPLIED, WITH RESPECT TO THE FIBER OPTIC CABLE OR ANY PART THEREOF.
Fiber Optic Cable. Six strands of fiber optic cable shall be designated for traffic signal interconnection along CSAH 32 (Cliff Road) as part of this project. The County will be responsible for all costs to install and maintain additional strands for the County’s use. The County will be responsible for operation and maintenance of the fiber optic cable for traffic signal interconnection and the County’s fiber optic cable network.
Fiber Optic Cable. Fiber optic cable is of suitable manufacture to provide long-term reliable service in a flooded underground ductbank or aerial outside environment.

Fiber Optic Cable. Landlord, at Landlord's expense, shall install fiber optic cabling and bring same to the presently existing telephone closet located on the Building's fourth floor prior to the Commencement Date.
Fiber Optic Cable. Pursuant to the terms of the Lease, Tenant, at its sole cost and expense, shall have the right to connect the Building and the adjacent property at 0000 Xxxxxxxxx Xxxxxx by installing, maintaining and operating a below-ground fiber-optic line or lines, data and telecommunications cabling, and conduits or such other similar technology as is then generally recognized as a reasonable supplement to or replacement for fiber-optic lines and data and telecommunications cabling (the “Inter-Building Communication Link”). Tenant, at its sole cost and expense, shall comply with all governmental agencies’ regulations and permit requirements and shall arrange for the installation of the underground conduit, the telephone, data transaction, video and other telecommunication services (“Telecommunication Services”) directly with one or more of Telecommunications Services providers and shall be solely responsible for paying for such Telecommunications Services including, but not limited to, the initial installation, maintenance, repairs and replacement and subsequent removal costs related to the Inter-Building Communication Link. Tenant shall provide Landlord with a complete description and detailed plans reflecting said Inter-Building Communication Link and connections for Telecommunications Services. After Landlord’s review and approval of said plans, Landlord and Tenant shall execute a Consent to Alterations agreement and Tenant can commence the construction of the Inter-Building Communication Link thereafter. All work in connection therewith shall be performed by licensed contractors approved by Landlord. Notwithstanding anything to the contrary herein, all conduit related cabling between the Building and the 0000 Xxxxxxxxx Xxxxxx property must be underground and no exterior equipment shall be above ground and no cabling can be visible from the exterior and/or interior of the Building and/or the 0000 Xxxxxxxxx Xxxxxx building. Upon expiration or earlier termination of this Lease Tenant shall remove the Inter-Building Communication Link and restore those elements of the Premises, the Building and other improvements in the Parcel affected by such removal.
