Filling Position for a Field Paramedic. Selection of persons to fill a posted job which may involve a lateral transfer will be governed by the following conditions: (a) Selection of persons to fill the posted permanent job shall be based on seniority among qualified applicants (PCP, ICP or ACP as the case may be) and by: (i) Employees who have completed probation; (ii) followed by term Employees who have not yet completed probation; these terms will then start the probation period over in the new site; (iii) then outside the bargaining unit; (iv) ICPs and ACPs who have completed less than twenty-four (24) months of employment as a full-time Employees (or equivalent hours of part-time employment) may be considered, but may be refused a posted position for operational reasons such as difficulty in obtaining an ALS replacement at the site where the Employee is working. (b) Term Employees are subject to the following conditions: (i) Term Employees can only apply for another term position during the last thirty (30) days of their term and may be required to complete their term before moving to a new term position unless the new term position is at the same site. On expiry of a term position, the former Term Employee shall, for a period of ninety (90) calendar days, or such earlier time as the former Term Employee accepts another position with the Employer, be given preference over a Casual Employee for any posted position for which the former Term Employee applies. It is understood that such preference does not give the individual status as an Employee or give any seniority date and, on receiving a posted position, a former Term Employee is subject to a new probationary period unless he/she has successfully completed his/her probationary period and has received a posted position within the ninety (90) calendar days. In the case of two or more people in this ninety day period applying for the same position, an interview will be conducted and the position will be awarded based on merit and ability. (c) When there are no qualified ACP applicants for a posted ACP position the employer may, at the employer’s discretion, repost for “ACP Student”. (i) ACP Student postings are open for those who are accepted or enrolled into a recognized ACP program. (ii) Positions posted for “ACP Student” will be awarded first by seniority, then open to those ACP students outside of the bargaining unit. Filling Position for a Field Paramedic. Selection of persons to fill a posted job which may involve a lateral transfer will be governed by the following conditions: (a) until the employee has completed twelve (12) months of full-time employment (or equivalent hours for Part-Time employee) at a site, an employee is not eligible to apply for a posting for another site; (b) selection of persons to fill the posted job shall be based on seniority among qualified applicants, except that: (i) preference will be given to employees from within the Administrative Area (although there is a province wide posting), and (ii) P2s and P3s who have completed more than one (1) year of employment as a Full-Time employee (or equivalent hours of a Part-Time employee), but less than two (2) years of employment as a Full-Time employee (or equivalent hours of part-time employment) may be considered, but may be refused a posted position for operational reasons such as difficulty in obtaining an ALS replacement at the site where the employee is working.
Filling Position for a Field Paramedic. (a) (iii) Casual employees on the basis of merit (which may include but is not limited to, skill and ability, performance appraisals, human resources file, direct supervisor support, absenteeism, etc. for which the applicant can seek feedback from the hiring Supervisor or Manager), but where the qualifications and abilities are equal, the total continuous hours worked with the employer shall be used as a tie breaker. Hours shall be calculated quarterly based on the last full pay period in the previous quarter. For term positions, preference will be given to casual employees within that region. A casual employee who has not worked in the previous sixty (60) calendar days may not be considered a candidate for the job posting; however, an employee on pregnancy, parental or adoption leave shall be eligible to apply for permanent positions.

Notwithstanding anything in this CCPS Agreement to the contrary, the Parties acknowledge and agree that (i) Bluebird may decline to perform any Commercialization activity proposed to be conducted by Bluebird in the Worldwide Commercialization Plan (other than Manufacturing of Vectors and associated Payloads), and (ii) the Worldwide Commercialization Plan will not include, and Bluebird will have no obligation to perform, any such Commercialization activity that Bluebird has declined to perform, provided that once Bluebird has agreed to perform a Commercialization activity, it will be obligated to perform, and cannot decline to perform, such activity. In addition, either Party may request at any time that the JGC consider and approve other updates to the Worldwide Commercialization Plan. Further: (a) The JGC will set the required form and contents of the Worldwide Commercialization Plan.   • RE-WEIGHING PRODUCT Deliveries are subject to re- weighing at the point of destination by the Authorized User. If shrinkage occurs which exceeds that normally allowable in the trade, the Authorized User shall have the option to require delivery of the difference in quantity or to reduce the payment accordingly. Such option shall be exercised in writing by the Authorized User.

  • Licensed Product The term “Licensed Product” shall mean any product (a) the manufacture, use, importation, sale or offer for sale of which would, in the absence of the license granted by this Agreement, infringe a Valid Claim of any of the Licensed Patent Rights, or (b) that is comprised of, utilizes or incorporates Licensed Biological Materials, or (c) that is discovered, developed or made using a Licensed Process.

  • Reformulation of Products As of the Effective Date, and continuing thereafter, Products that Xxxxxx Xxxxxx directly manufactures, imports, distributes, sells, or offers for sale in California shall either: (a) be Reformulated Products pursuant to § 2.2, below; or (b) be labeled with a clear and reasonable exposure warning pursuant to §§ 2.3 and 2.4, below. For purposes of this Settlement Agreement, a “Reformulated Product” is a Product that is in compliance with the standard set forth in § 2.2, below. The warning requirement set forth in §§ 2.3 and 2.4 shall not apply to any Reformulated Product.

  • SOURCE CODE ESCROW FOR LICENSED PRODUCT If Source Code or Source Code escrow is offered by either Contractor or Product manufacturer or developer to any other commercial customers, Contractor shall either: (i) provide Licensee with the Source Code for the Product; or (ii) place the Source Code in a third party escrow arrangement with a designated escrow agent who shall be named and identified to the State, and who shall be directed to release the deposited Source Code in accordance with a standard escrow agreement acceptable to the State; or (iii) will certify to the State that the Product manufacturer/developer has named the State, acting by and through the Authorized User, and the Licensee, as a named beneficiary of an established escrow arrangement with its designated escrow agent who shall be named and identified to the State and Licensee, and who shall be directed to release the deposited Source Code in accordance with the terms of escrow. Source Code, as well as any corrections or enhancements to such source code, shall be updated for each new release of the Product in the same manner as provided above and such updating of escrow shall be certified to the State in writing. Contractor shall identify the escrow agent upon commencement of the Contract term and shall certify annually that the escrow remains in effect in compliance with the terms of this clause. The State may release the Source Code to Licensees under this Contract who have licensed Product or obtained services, who may use such copy of the Source Code to maintain the Product.

  • Indemnification for Marketing Materials In addition to the foregoing indemnification, the Fund and the Investment Adviser also, jointly and severally, agree to indemnify and hold harmless each Underwriter, affiliates, directors, officers, employees and agents of each Underwriter, and each person, if any, who controls any Underwriter within the meaning of Section 15 of the 1933 Act or Section 20 of the 1934 Act, against any and all loss, liability, claim, damage and expense described in the indemnity contained in Section 6(a), as limited by the proviso set forth therein, with respect to any sales material.
