No encroachments are to exist by the Project onto premises outside the boundary lines of the Premises or by existing improvements located on adjacent premises onto the Premises other than those that are Permitted Liens or that may have been consented to by Owner and Assignee and all set-back requirements have been complied with. If any discrepancies exist between the legal description set forth on the Survey delivered pursuant to paragraph (b) of Section 9.24 hereof and the legal description set forth on the Final Survey delivered pursuant to this paragraph (g), Owner and Agent shall cooperate in amending the legal descriptions in all recorded documents creating or affecting the Premises, including, without limitation, any Easements, to reflect the correct as-built description.
Final SurveyWith respect to the final Advance of the Loans, if then prepared and available, receipt by Agent of a final Survey reasonably acceptable to Agent showing the as built location of the Project (and if not so prepared and available Borrower hereby covenants to deliver such Survey to Agent within one hundred and twenty (120) days after the date of the final Advance).
