(b) Treasury Board, as defined in the Financial Administration Act, not having controlled or limited expenditure under any appropriation necessary in order to make such payment.
Financial Administration Act. 32.1 Pursuant to the provisions of the Financial Administration Act, R.S.O 1990, c. F.12, as amended, the Ministry’s payment obligations set out in this Agreement are subject to:
(a) the Ministry securing the requisite appropriation for payment during the Province's Fiscal Year in which payment is due; or
(b) the Ministry securing the requisite appropriation for a multi-year payment during a previous Fiscal Year which covers the year in which payment is due.
