Flood Control. Nothing in this Agreement affects or alters the obligations, rights, and privileges of the entities under the Treaty relating to operation and compensation for flood control and without restricting the generality of the foregoing, it is expressly agreed that any reduction in generation in the United States brought about by operation for flood control under the Treaty or any flood control arrangements made pursuant to the Treaty shall not be a reduction in the Canadian Entitlement for which compensation is required under this Agreement.
Flood Control. Each Loan Party, the Real Property Collateral and the use and operations of the Real Property Collateral are in compliance in all material respects with the provisions of all flood control laws, ordinances and other regulations applicable to the Real Property Collateral (including laws, ordinances and regulations of the Cxxxx County Flood Control District) and all agreements relating to flood control with respect to the Real Property Collateral.

Installation of flood or rain gauges in previously developed urban complexes when the work does not require modification of buildings, structures 45 years or older, is not within 500 feet of the boundaries of a historic property and occurs within previously disturbed soil or adjacent to streams where the gauge hole does not disturb an area greater than 10' x 10'. NOTE: This allowance does not apply to installation of related facilities, such as stilling xxxxx or job boxes, unless in previously disturbed soils, nor to work proposed in inactive cemeteries, burial grounds, previously recorded archaeological sites, archaeologically sensitive areas, historic landscapes, and sites of significance to Tribes.
Flood Control. The Parties agree that the Licensee pursuant to proposed Article A130, will comply with the rules and regulations prescribed by the U.S. Army Corps of Engineers. The Parties reserve the right to present evidence or argument relative to the impacts posed by any flood control proposal raised by any intervenor or otherwise before the Commission or the U.S. Army Corps of Engineers.
