Foreign Personnel. Seller shall not give any Foreign Person access to Technical Data or software as those terms are defined in the applicable Export Laws and Regulations without the prior written consent of Buyer. Any request for such consent must state the intended recipient's citizenship(s), and status under 8 U.S.C. 1101 and 8 U.S.C. 1324 (the "Immigration and Naturalization Act"), and such other information as Buyer may reasonably request. No consent granted by Xxxxx in response to Seller's request under this paragraph b shall relieve it if its obligations to comply with the provisions of paragraph a or the Export Laws and Regulations, nor shall any such consent constitute a waiver of the requirements of paragraph a, nor constitute consent for Seller to violate any provision of the Export Laws and Regulations.

Foreign Personnel. 2.3.1 For foreign personnel employed on international conditions, as well as rotation of foreign personnel from the same group, work that falls under the scope of the Agreement must be performed for compensation which, on the basis of an overall evaluation, costs the employer an equal amount as the total due to a similar employee who is covered under this Agreement and who performs similar work. Compensation and working hours shall be based on the assumption that the work during the calculation period shall not exceed an average of 33.6 hours per week. For the purpose of comparison, compensation shall only include payment which it is assumed that the employee will report for tax purposes. Such personnel shall only be utilized when necessary in order to manage peak work loads that the company does not have sufficient Norwegian personnel to cover, as well as when necessary in order to meet a need for specialized labor. The use of such personnel shall be discussed with the union representatives in advance. The use of such personnel, as well as the overall evaluation of the compensation level, shall be checked by Industry Energy and The Norwegian Oil and Gas Association, as the parties agree that this provision shall not lead to a situation wherein it becomes cheaper to use foreign labor as compared with Norwegian labor. 2.3.2 This agreement does not apply to foreign module, pipe, cable and construction personnel pursuant to Clause 3.13.1 if: a) the vessel is not subject to the regulations relating to worker protection and working environment in the petroleum sector, b) the company is bound by an approved agreement with ITF for all offshore service company vessels that are operating in North-Western Europe with this type of personnel, and c) the share of the personnel that is comprised by this agreement or have corresponding benefits, cf. Clause 2.3.1, exceeds 50% of the number of employees in this group on the individual vessel. For companies with several vessels on the Norwegian Shelf, the 50% share can be calculated on the basis of the total number of vessels, inclusive of ROV personell, Diving personnel and Survey Personnel. Until further notice, this agreement does not apply to lay barges and large, specialized crane barges/vessels with an ITF agreement. Foreign Personnel. Foreign personnel assigned to work in Equatorial Guinea on behalf of the Contractor or its sub-contractors, and their families, shall be permitted to import their personnel effects into Equatorial Guinea free of customs duties.
Foreign Personnel. The Contractor may bring in to the Country any foreign personnel who are necessary for the execution of the Works to the extent allowed by the Laws. The Contractor shall ensure that these personnel are provided with the required residence visas and work permits. The Employer will, if requested by the Contractor, use his best endeavours in a timely and expeditious manner to assist the Contractor in obtaining any local, state, and national or government permission required for bringing in the Contractor’s personnel. The Contractor shall be responsible for the return of these personnel to the place where they were recruited or to their domicile. In the event of the death in the Country of any of these personnel or members of their families, the Contractor shall similarly be responsible for making the appropriate arrangements for their return or burial. Where the Contractor requires repayment of travel costs of foreign personnel initially borne by the Contractor, the terms of repayment shall be reasonable, made clear to the worker, and documented, prior to the worker leaving their country of origin. The worker shall signify agreement with the terms of the loan and its repayment, and shall be entitled to resign under the terms of national labour legislation and elect to repay the outstanding debt.
Foreign Personnel. Seller shall obtain advanced written permission from the Buyer Procurement Representative prior to a non-US Person, representing Seller or Seller Engaged Personnel, visiting or performing Work at a facility that is owned, operated or managed by Buyer or its customer. In the absence of such written permission, which shall be granted at Seller’s sole discretion, all non-US Persons are prohibited from visiting or performing Work at any facility that is owned, operated or managed by Buyer or its customer. The term “US Person” is defined in the International Traffic in Arms Regulations (“ITAR”) at 22 CFR §120.15.

Foreign Personnel. If Cards are distributed by Customer or at its instruction to Cardholders outside of the United States, Customer shall be solely responsible for complying with any applicable foreign employment and/or data privacy laws or requirements in connection therewith, including but not limited to any requirements to provide notices or disclosures to or to obtain consents from Cardholders. Foreign Personnel. The Supplier may recruit foreign staff and labourers as are required in order to supply of the Purchase Order, after agreement with the Relevant Authorities. Foreign Personnel. The Government agrees to: (A) arrange for any foreign personnel (either individual consultants or personnel of firms) providing goods, works or services under the Compact to be provided promptly with any necessary work visas and to arrange for such foreign personnel and their family to be provided promptly with entry visas; and (B) provide the foreign personnel (either individual consultants or personnel of firms) providing goods, works or services under the Compact with work permits and such other documents as shall be necessary to enable the foreign personnel to perform services and to remain in Nepal for the duration of the Compact, without the need to exit the country for any period in the interim.
