FREE DAYS AND HOLIDAYS. (a) During each rehearsal week, each ARTIST will receive two (2) Free Days as defined herein. If the ARTIST is required to perform or rehearse on a legal holiday set forth below or if the holiday is scheduled to be celebrated on the regular Free Day, the ARTIST shall receive an extra Free Day within the succeeding or preceding two (2) week period of employment except for the following holidays: Thanksgiving Day, Christmas Day and New Year's Day. On these holidays, the extra Free Day may be scheduled within the succeeding or preceding four (4) week period of employment. In the event that an alternate Free Day cannot be scheduled, the ARTIST will be compensated at one-sixth (1/6th) of the weekly salary. Each performance week shall have one (1) Free Day in each Monday through Sunday week with the Free Day occurring not later than the seventh (7th) day in the City of Origination, and the tenth (10th) day on tour or during NUTCRACKER, following the immediately preceding Free Day. (b) ARTISTS may not be required to rehearse and/or perform on the following legal holidays: Labor Day, Independence Day, Memorial Day, Xxxxxx Xxxxxx Xxxx Day, Thanksgiving Day, Christmas Day, New Year's Day and Easter Sunday. All such legal holidays shall be in addition to the regularly scheduled Free Days as set forth in (a) above. Legal holidays which fall on a Sunday do not require an additional Free Day during that same week, provided the ARTIST shall have an alternate Free Day scheduled. (c) For tours which are in excess of twenty-one (21) days, the EMPLOYER shall designate the Free Day on the first business day or a mutually agreeable day immediately following the Company's return to the City of Origination.

FREE DAYS AND HOLIDAYS. (a) During each five (5) day Rehearsal Week, each ARTIST will receive two (2) consecutive Free Days as defined herein. (b) ARTISTS may not be required to rehearse and/or perform on the following legal holidays: Labor Day, Independence Day, Juneteenth, Memorial Day, Xxxxxx Xxxxxx Xxxx Day, Thanksgiving, Christmas, New Year’s Day and Easter Sunday. All such legal holidays shall be in addition to the regularly scheduled Free Days. In addition, EMPLOYER will not deny any requests for Personal Days for religious observances during the week prior to Tech Week and during Tech/Performance Weeks, provided ARTIST submits such a request along with the return of their Individual Artist Agreement. For any request submitted past this deadline, approval will be given at the EMPLOYER’s discretion. If an unforeseen emergency circumstance (e.g. infectious virus affecting a majority of the company) could potentially result in the cancellation of a Performance as a direct result of this ARTIST’s request, then EMPLOYER and AGMA will meet to discuss a mutually agreeable resolution. 1. If the ARTIST is required to perform or rehearse on a legal holiday or if the holiday is scheduled to be the regular Free Day, the ARTISTS shall receive an extra Free Day within the succeeding or preceding two (2) week period of employment except Thanksgiving, Christmas, New Year’s Day and Xxxxxx Xxxxxx Xxxx Day which shall have the extra Free Day scheduled within the succeeding or preceding four (4) week period of employment. EMPLOYER will give no fewer than four (4) weeks notice of when such extra Free Days are to be scheduled. 2. If an alternate Free Day cannot be scheduled, ARTISTS will be given no fewer than three

(b) Each Performance Week or six (6) day Rehearsal Week shall have one (1) Free Day in each week, with the Free Day occurring by not later than the tenth (10th) day following the immediately preceding Free Day. (c) If the ARTIST is required to perform any service at any time during a Free Day, the ARTIST shall be compensated at the hourly Penalty Rate of $28.00 with a two-(2)-hour minimum call payable thereafter in one-quarter (1/4) hour increments. (d) Holidays ARTISTS may not be required to rehearse and/or perform on the following legal holidays: Labor Day, Memorial Day, Thanksgiving, Christmas, New Year's Day and Easter Sunday. All such legal holidays shall be in addition to the regularly scheduled Free Days. ARTISTS will be compensated for said legal holidays that occur during a Rehearsal or Performance Week. If the ARTIST is required to perform or rehearse on a legal holiday or if the holiday is scheduled to be the regular Free Day, the ARTISTS shall receive an extra Free Day within the succeeding or preceding two (2) week period of employment except Thanksgiving, Christmas and New Year's Day which shall have the extra Free Day scheduled within the succeeding or preceding four (4) week period of employment. If an alternate Free Day cannot be scheduled ARTISTS will be compensated at one-sixth (1/6) of the weekly salary. (e) For tours which are in excess of twenty-one (21) days, the EMPLOYER shall make best efforts to designate the Free Day on the first business day or a mutually agreeable day immediately following the Company's return to the City of Origination.

C. ARTISTS may be required to rehearse and/or perform on the following paid legal holidays: Independence Day, Thanksgiving, Christmas, and New Year’s Day and ARTISTS making less than $2500/week will be compensated at an additional one-sixteenth (1/16) of the minimum weekly salary for each such performance. D. The EMPLOYER shall give the ARTISTS not less than four (4) weeks’ advance notice of the intended performance schedule (including the scheduling of Free Days) for each performance week. After having given such notice, EMPLOYER may alter the schedule of performances and Free Days, but not less than two (2) weeks notification must be given prior to the applicable week for which such change is made.

For tours which are in excess of twenty-one (21) days, the Employer shall use all best efforts to designate the Free Day on the day immediately following the Company’s return to the City of Origination.

If the ARTIST is required to perform or rehearse on any of the above legal holidays, or if any of the above legal holidays is scheduled to be the regular Free Day, the ARTIST shall receive an extra Free Day: (1) during performance weeks, within the succeeding or preceding four (4) week period of employment, or; (2) during rehearsal weeks, within the succeeding or preceding two (2) week period of employment. If an alternate free day cannot be scheduled ARTISTS will be compensated at one-sixth (1/6) of the weekly salary; (3) For all tours, the EMPLOYER shall designate the Free Day on the first (1st) day or a mutually agreeable business day immediately following the company's return to the city of origination.

  • Paid Holidays – Long Weekends (a) When an employee is scheduled to work a weekend where a paid holiday falls on the Monday or the Friday, the Employer shall endeavour to also schedule the employee to work the paid holiday. (b) When the employee is scheduled off on a weekend where a paid holiday falls on the Monday or the Friday, the Employer shall endeavour to schedule the employee off the paid holiday. (c) In the event of a scheduling conflict, 12.07 (a) will be the deciding provision.
