FREE DAYS AND HOLIDAYS. (a) During each rehearsal week, each ARTIST will receive two (2) Free Days as defined herein. If the ARTIST is required to perform or rehearse on a legal holiday set forth below or if the holiday is scheduled to be celebrated on the regular Free Day, the ARTIST shall receive an extra Free Day within the succeeding or preceding two (2) week period of employment except for the following holidays: Thanksgiving Day, Christmas Day and New Year's Day. On these holidays, the extra Free Day may be scheduled within the succeeding or preceding four (4) week period of employment. In the event that an alternate Free Day cannot be scheduled, the ARTIST will be compensated at one-sixth (1/6th) of the weekly salary. Each performance week shall have one (1) Free Day in each Monday through Sunday week with the Free Day occurring not later than the seventh (7th) day in the City of Origination, and the tenth (10th) day on tour or during NUTCRACKER, following the immediately preceding Free Day.

ARTISTS may not be required to rehearse and/or perform on the following legal holidays: Labor Day, Juneteenth, Independence Day, Memorial Day, Xxxxxx Xxxxxx Xxxx Xxx, Thanksgiving, Christmas, and New Year's Day. All such legal holidays shall be in addition to the regularly scheduled Free Days. If the ARTIST is required to perform or rehearse on a legal holiday or if the holiday is scheduled to be the regular Free Day, the ARTISTS shall receive an extra Free Day within the succeeding or preceding six (6) week period of employment. Requests from EMPLOYER to schedule a free day outside of this period may be discussed and mutually agreed to by the AGMA Committee and shall not unreasonably be denied. If an alternate Free Day cannot be scheduled ARTISTS will be compensated at one- sixth (1/6) of the weekly salary. Legal holidays which fall on a Sunday do not require an additional Free Day during that same week, provided the ARTIST shall have an alternate Free Day scheduled. d. For tours which are in excess of twenty one (21) days, the EMPLOYER shall designate the Free Day on the first business day or a mutually agreeable day immediately following the Company's return to the City of Origination.

(b) Each Performance Week shall have one (1) Free Day within each Monday through Sunday Week, with the Free Day occurring by not later than the tenth (10th) day following the immediately preceding Free Day. In a Performance Week in the City of Origination with a Sunday performance, the Free Day will be the immediately following Monday, but if that Free Day falls in a layoff week, no Free Day is required, and ARTISTS shall not be paid for that day. (c) Except as set forth in the following sentence, ARTISTS may not be required to rehearse and/or perform on the following legal holidays: Labor Day, Independence Day, Memorial Day, Xxxxxx Xxxxxx Xxxx Day, Thanksgiving, Christmas, New Year's Day, and Easter Sunday. All such legal holidays shall be in addition to the regularly scheduled Free Days. If, however, the ARTIST is required to perform or rehearse on a legal holiday or if the holiday is scheduled to be the regular Free Day, the ARTISTS shall receive an extra Free Day within the succeeding or preceding two (2) week period of employment, except Thanksgiving, Christmas, New Year's Day and Xxxxxx Xxxxxx Xxxx Day, which shall have the extra Free Day scheduled within the succeeding or preceding four (4) week period of employment. If an alternate Free Day cannot be scheduled, ARTISTS will be compensated at one-sixth (1/6) of the weekly salary. The EMPLOYER will provide 45 days’ notice if the Friday after Thanksgiving is a free day. Legal holidays which fall on a Sunday do not require an additional Free Day during the same week, provided the ARTIST shall have an alternate Free Day scheduled. (d) For tours which are in excess of twenty-one (21) days, the EMPLOYER shall designate the Free Day on the first business day or a mutually agreeable day immediately following the Company's return to the City of Origination. (e) In the event that the ARTIST is called to rehearse at any time during a Free Day as defined in Paragraph 38(j) of this Agreement, the ARTIST shall be compensated at the following hourly rates: Free Day Rate ARTIST’s hourly base rate x 2.5 payable in one-half (1/2) hour increments with not less than a two (2)-hour call. There shall be no pyramiding or double-payment of this payment with Overtime.

In the absence of special circumstances or needs, those two (2) Free Days shall be Saturday and Sunday. b. Artists may not be required to rehearse and/or perform on the following legal holidays: Labor Day, Independence Day, Memorial Day, Juneteenth, Thanksgiving, Christmas, New Year’s Day and Xxxxxx Xxxxxx Xxxx, Xx. Day. All such legal holidays shall be in addition to the regularly scheduled Free Days. If there is a performance scheduled on the legal holiday, the Artists shall receive an extra Free Day within the succeeding or preceding four (4) week period of employment. c. For tours which are in excess of twenty-one (21) days, the Employer shall use all best efforts to designate the Free Day on the day immediately following the Company’s return to the City of Origination.
