Future Services. The Consultant acknowledges each of the following with regard to performing future services for the City: • The Consultant’s performance of the services required by this Agreement may create an actual or appearance of a conflict of interest with regard to the Consultant performing or participating in the performance of some related future services, particularly if the services required by this Agreement comprise one element or aspect of a multi-phase process or project; • Such an actual or appearance of a conflict of interest would be a ground for the City to disqualify the Consultant from performing or participating in the performance of such future services; and • The Consultant is solely responsible for considering what potential conflicts of interest, if any, performing the services required by this Agreement might have on its ability to obtain contracts to perform future services.
Future Services. Developer hereby agrees to perform the following development services for and as an agent of Owner.
Future Services. Developer shall monitor construction of the Apartment Housing for Owner and shall provide Owner with information requiring Owner's intervention to resolve construction issues. Owner shall allow Developer full access to the Apartment Housing during the construction period. Developer and Developer's agents shall perform their work in a manner that minimizes interference with the management and operation of the Apartment Housing.
(1) Developer shall exert its best efforts to ensure that the Contractor performs its obligations under the Construction Documents in a diligent and timely manner.
(2) Developer shall monitor pre-construction conferences and review pre-construction documents, including drawings, specifications, contracts, and schedules.
(3) Developer shall identify construction issues and inform Owner of the same.
(4) Developer shall review subcontract bids received by the Contractor and make a recommendation to the Owner.
(5) Developer shall monitor field order and change order procedures and inform the Owner.
(6) Developer shall attend construction progress meetings at the Apartment Housing site to monitor construction progress and report to the Owner the outcome of those meeting.
(7) Developer shall review the Contractor's monthly pay applications.
(8) Developer shall monitor the Contractor's progress with respect to the approved Apartment Housing schedule and keep the Owner informed of all pertinent Apartment Housing issues and construction progress.
(9) Developer shall advise Owner with respect to relations with engineers, architects, and other construction professionals.
(10) Developer shall maintain relations with the City of Fernley and other governmental authorities having jurisdiction over development of the Apartment Housing and inform the Owner of any construction or building issues.
Future Services. Client authorizes this signed contract to be valid for future services without additional signed contracts or written authorization.
Future Services. This agreement will also apply to services rendered for such future matters that we agree will be handled by the Firm. If, however, such services, are substantially different from those to which this agreement applies (for instance, an appearance on your behalf in court), either party may request that a new agreement be executed, or that this agreement be reacknowledged.
Future Services. Developer shall oversee construction of the Apartment Housing on Owner's behalf, as provided in this Section 2.3(b)(1). Owner shall allow Developer full access to the Apartment Housing during the construction period. Future Services. Providing services relative to future facilities, systems and equipment which are not intended to be constructed as a part of the Project.
Future Services. EarthLink and SKT Holdings acknowledge that the list of Restricted Services is complete as of the date first above written. If EarthLink or SKT provides, any future products or services within the United States, such as wired-wireless integrated service or satellite/terrestrial digital broadcasting services, that are excluded from the then-current scope of Restricted Services, then, for so long as such Member or a Subsidiary of such Member owns a share of Class B Common Stock, EarthLink and SKT shall negotiate in good faith whether or not to include such services as part of the Restricted Services.
Future Services. The Parties recognize that the telecommunications industry is undergoing dramatic transformation due to radical technological improvements and regulatory developments. Thus, notwithstanding the alliance pricing system set forth in this Section, subject to regulatory restraints, each Party will develop a mechanism to **** to the other the benefits of increased efficiencies (e.g., due to technology development or regulatory evolution).
Future Services. Muzak shall conduct research and development to --------------- maintain and improve the quality of the Services and the methods used to distribute them. In the event that Muzak develops new subscription music services, or new communications services in the nature of the Adjunct Services, after the date hereof, Muzak shall amend Exhibit A or Exhibit B, as the case may be, in the manner provided in Section 2.1 above (including the requirement of at least six months' prior notice to Licensee of such amendment) to add such new Services thereto, thereby giving Licensee the right and, subject to Exhibit E hereto, the obligation to distribute such Services in the Territory under the terms of this Agreement.
