GENERAL SECTION. A. There will be no reprisals of any kind taken against any teacher by reason of his/her membership in the Association or participation in its activities. B. Any teacher whose appearance is necessary at an arbitration hearing or fact finding session, which is set by mutual agreement between the Committee and the Association or ordered by the neutral party, held during the school day will, upon notice to his/her principal or immediate superior and to the Superintendent by the Chairman of the PR & R Committee to be released without loss of pay as necessary in order to permit participation in the foregoing activities. C. Teachers will be entitled to full rights of citizenship, and no religious or political activities of any teacher or lack thereof will be grounds for any discipline or discrimination with respect to the professional employment of such teacher. D. The President of the Association will be provided with a copy of the agenda of all open meetings of the Committee and copies of the minutes of open meetings whenever practical. E. If any provisions of this Agreement or any application of this Agreement shall be found contrary to law, then such provision or application shall not be deemed valid and subsisting except to the extent permitted by law, but all other provisions or applications will continue in full force and effect. F. The Committee will, upon request, provide the Association with any public documents available to the citizens of Weymouth which will assist the Association in developing intelligent, accurate, informed and constructive proposals for presentation at negotiations. G. 1. If there is to be a reduction in the number of teachers, the following procedure shall be implemented:

GENERAL SECTION. 6.1. The Supplier will only retain operational records for a limited period following the performance of Services. Any query regarding performances shall be raised by the Customer within a period of 7 days from the date to which the query relates. The Supplier agrees to hold the charges as set out in the Agreement firm for one year from the Start Date except where any Government action or legislative or taxation changes give rise to an increase in prime costs of labour, materials or other expense. In such circumstances the Supplier shall be entitled to make a pro-rata increase in the charge due for the supply of the relevant portion of Services (provided the Agreement has been in force for not less than three months) on giving one- month notice to the Customer in writing. 6.4. Neither party is entitled to assign or transfer the benefit and/or burdens of this Agreement without the prior written consent of the other which it may withhold inter alia if it reasonably considers that any rights it may have are likely to be prejudiced or adversely affected.

GENERAL SECTION. Service Providers may share information for the provision of services to eligible persons through a networked infrastructure. Service Providers shall at all times have rights to the data pertaining to their Clients that was created or entered by them in HMIS, subject to requirements under the law. Service Providers shall be bound by all restrictions imposed by the Service Provider’s Clients pertaining to the use of Protected Personal Information2 (PPI). It is a Client’s decision whether their PPI entered into HMIS shall be shared with other Service Providers. The Client Consent & Release of Information Authorization shall be signed if the Client agrees to share their information with other Service Providers. Minimum data entry required on each Client includes, but is not limited to, the Universal Data Elements as listed below: Name Gender Destination Social Security Number Veteran Status Relationship to Head of Household Date of Birth Disabling Condition Client Location Race Project Start Date Housing Move-In Date Ethnicity Project Exit Date Living Situation Data necessary for the development of aggregate reports of homelessness services, including services needed, services provided, referrals and Client goals and outcomes should be entered to the greatest extent possible, subject to the Client’s consent or restrictions. HMIS is used to assist Service Providers in focusing services and locating alternative resources to help persons experiencing or at risk of homelessness. Therefore, the Service Provider staff should use the Client information in the HMIS system to target services to the Client’s needs.
