From time to time, the Credit Union may amend any of the terms and conditions contained in this agreement. Such amendments shall become effective as stated on any notice sent to you, the member. Examples of such notices might include, but are not limited to, newsletters, disclosures, etc. By using Remote Deposit, you accept all the terms and conditions of this agreement. Please read it carefully. The terms and conditions of member’s Membership Agreement and the Truth-In-Savings Schedule for member’s deposit accounts and each of member’s loan agreements continue to apply notwithstanding anything to the contrary in this agreement. You agree to abide by and comply with all local, state, and federal rules, laws and regulations. These rules include but are not limited to Regulation CCExpedited Funds Availability Act”, its Subparts B, C and D (Subpart D implements the Check Clearing for the 21st Century Act (Check 21 Act). The Bank Secrecy Act (BSA), and laws administered by the United States of America which are in existence as of the date of this agreement and as amended from time to time.

General Terms and Conditions Agreement. This Agreement establishes the rules that govern the processing of deposited checks through member’s account(s) using Georgia’s Own Mobile Deposit. The acceptance of this Agreement or use of the Service means you agree to all terms and conditions in this Agreement. Please read this Agreement carefully and keep a copy for your records. In addition to this Agreement, your Accounts are also governed by our Membership Agreement and Disclosures and our Truth In Savings Disclosure (together, the “Deposit Agreement”). However, in the event of a conflict, the terms and conditions of this Agreement shall supersede the terms and conditions of the Deposit Agreement with respect to the deposits made through the Service. Deposits made through other channels continue to be governed by the Deposit Agreement. Georgia’s Own may change this Agreement at any time. Mobile Remote Deposit Service is subject to the following terms and conditions and to the instructions, rules and terms provided. The following are requirements that must be met for initial approval to use the Mobile Deposit service: • You are at least 18 years old, • You are enrolled in Online Banking with a valid email address, • Your account has been opened for greater than 30 days, and • Your account has an active status. We reserve the right to deny access to the Mobile Deposit service at any time due to any adverse circumstances with your membership account, including, but not limited to, account restrictions, fraudulent activity or loan default.

CLEC agrees to enter into traffic exchange agreements with third-parties prior to routing any Transit Traffic to CenturyLink for delivery to such third parties, and CLEC will indemnify, defend and hold harmless the Transit Service provider against any and all charges levied by such third-party terminating carrier with respect to Transit Traffic, including but not limited to, termination charges related to such traffic and attorneys’ fees and expenses.
