Goods in Transit. 1. The provisions of the Agreement may be applied to goods exported from either Tunisia to Croatia or from Croatia to Tunisia, which comply with the provisions of Protocol 4 to the Agreement and that on the date of accession of Croatia are either en route or in temporary storage, in a customs warehouse or in a free zone in Tunisia or in Croatia. 2. Preferential treatment may be granted in such cases, subject to the submission to the customs authorities of the importing country, within four months from the date of accession of Croatia, of a proof of origin issued retrospectively by the customs authorities of the exporting country.
Goods in Transit. 1) If prior to delivery or while the goods are in transit, Buyer or Seller becomes bankrupt or insolvent, or any petition in bankruptcy or for the reorganization or for a state court receivership is filed against Buyer or Seller, as the case may be, then the other party hereto may forthwith terminate this contract by giving written notice of such termination. 2) Such termination shall not affect any claim for damages available to the Buyer, provided that if Xxxxx is then indebted to Seller, the amount of any such damage claim shall be abated to the extent that the indebtedness of Buyer to Seller, as actually paid in money, is abated by any order of judgement entered or any plan adopted in any bankruptcy, reorganization, receivership, or similar proceeding. Such termination shall not prejudice the Seller’s rights to any amounts then due under the contract. 3) If Buyer becomes bankrupt or insolvent or any petition in bankruptcy or for reorganizing or if a state court receivership is filed against Buyer, then, at its option Seller may take possession of any goods theretofore sold to Buyer, in connection with which the full purchase price has not been paid, analogous to the terns and provisions set forth in Paragraphs 11 and 12 hereinafter.

Provided that this Exception shall not apply to loss, destruction, or damage not otherwise excluded that results from a Defined Peril, or from collision, derailment, overturning, stranding, burning, or sinking of a ferry or watercraft; (g) export shipments which have been laden on board export conveyance or have come under the protection of marine insurance whichever first occurs; (h) import shipments until fully discharged from import conveyance or until marine insurance has ceased to cover whichever last occurs.
Goods in Transit. Seller hereby agrees that it shall not, and shall not permit its Affiliates to, make any payment of amounts due and payable by Seller to any third party supplier with respect to any Inventory that is in transit on the Closing Date without the prior written consent of Buyer, which consent shall not be unreasonably withheld. For purposes of clarification, it shall be unreasonable for Buyer to withhold consent to payment for goods which substantially conform to their specifications. Seller shall notify Buyer in writing as soon as practicable in advance of any deadline for payment of such amounts and Buyer shall have five (5) Business Days from receipt of such notice to provide Seller with its consent (or its determination not to provide such consent). In the event Buyer does not consent as set forth in the preceding sentence, Seller shall pay to Buyer the value of the Inventory as to which Buyer did not consent to payment (such value to be determined in accordance with Section ‎3.3(a)(i)(3). Buyer and Seller shall cooperate and good faith seek to mutually agree on the treatment of non-conforming goods for which payment was denied pursuant to this Section ‎6.14.

Goods in Transit. (a) No claim in respect of any loss or damage to goods in transit or any shortage on delivery will be accepted unless notice of such claim shall have been marked upon any drivers delivery ticket or invoice and the Company also receives separate written notice of damage or shortage within 3 days of the date of arrival of the goods or written notice of loss within 14 days of the date of the invoice. In addition all conditions imposed by the carrier must be complied with and such other steps are to be taken by the Buyer (including where applicable giving shorter notice to the carrier concerned) as are necessary to preserve a claim against the carrier. (b) No liability will be accepted for any damage in transit of which notice is given after the goods have been handled in any way by the buyer.
