Government Agency Claims Exception. (a) Nothing in this Agreement prevents or prohibits Employee from filing a claim with or participating in an administrative investigation or proceeding of a government agency, such as the U.S. Equal Employment Opportunity Commission, that is responsible for enforcing a law on behalf of the government. However, Employee understands that, because Employee is waiving and releasing all claims for monetary damages and any other form of personal relief, except as set forth above, Employee may only seek and receive non-personal forms of relief through any such claim.
(b) Employee further understands and acknowledges that nothing in this Agreement prohibits, penalizes, or otherwise discourages Employee from reporting, providing testimony regarding, or otherwise communicating any nuclear safety concern, workplace safety concern, public safety concern, or concern of any sort, to the U.S. Department of Labor or any federal or state government agency.
(c) Employee also understands and acknowledges that nothing in this Agreement shall be construed to prohibit him from engaging in any activity protected by the Xxxxxxxx-Xxxxx Act, 18 U.S.C. § 1514A and the Xxxx-Xxxxx Xxxx Street Reform and Consumer Protection Act, Pub. L. No. 111-203, H.R. 4173.
(d) Nothing in this Agreement prohibits or restricts Employee from: (i) making any disclosure of information required by law; and (ii) providing information to, or testifying or otherwise assisting or cooperating in any investigation or proceeding brought by, any federal regulatory or law enforcement agency or legislative body, any self-regulatory organization in compliance with a valid court order, or the Company’s designated legal compliance officer. Employee agrees to promptly provide written notice to Company if he is requested to provide information or testimony.
Government Agency Claims Exception. Nothing in this Section 3, or elsewhere in this Agreement, prevents or prohibits Employee from filing a claim with a government agency, such as the U.S. Equal Employment Opportunity Commission (“EEOC”) that is responsible for enforcing a law on behalf of the government. However, Employee understands that, because Employee is waiving and releasing all claims “for monetary damages and any other form of personal relief” (per Section 3.1(e) above), Employee may only seek and receive non-personal forms of relief through any such EEOC claim or related claim with a state agency. Nothing in this Agreement precludes a claim or limitation of rights under the Xxxxxxxx-Xxxxx Act of 2002.
Government Agency Claims Exception. Nothing in this Section 2, or elsewhere in this Agreement, prevents or prohibits you from filing a claim with a government agency, such as the U.S. Equal Employment Opportunity Commission, that is responsible for enforcing a law on behalf of the government. 3.

Nothing in Section 2 above, or elsewhere in this Agreement, prevents or prohibits the Executive from filing a claim with a government agency, such as the U.S. Equal Employment Opportunity Commission, that is responsible for enforcing a law on behalf of the government. However, the Executive understands that he may only seek and receive non-personal forms of relief through any such claim unless otherwise provided by law.
Government Agency Claims Exception. Nothing in the general release and waiver set forth above, or elsewhere in this Agreement, limits Employee’s rights under applicable law to provide truthful information to, or prevents or prohibits Employee from filing a claim with or participate in an investigation conducted by, a government agency, such as the U.S. Equal Employment Opportunity Commission, that is responsible for enforcing a law on behalf of the government. Notwithstanding the foregoing, Employee agrees to waive Employee’s right to recover monetary damages or any other personal relief in connection with any charge, complaint or lawsuit filed by Employee or anyone else on Employee’s behalf (whether involving a governmental entity or not); provided that Employee is not agreeing to waive, and this Agreement shall not be read as requiring Employee to waive, any right Employee may have to receive an award for information provided to any governmental entity.
Government Agency Claims Exception. Nothing in this Agreement prevents or prohibits Employee from filing, cooperating, or assisting in any government investigation or proceeding. Notwithstanding the foregoing, Employee represents that he has not made any legal claim against Yuma, and he agrees to waive his right to recover monetary damages in any charge, complaint or lawsuit filed by him or by anyone on his behalf.
Government Agency Claims Exception. Nothing in this Agreement restricts or prohibits you from initiating communications directly with, responding to any inquiries from, providing testimony before, providing confidential information to, reporting possible violations of law or regulation to, or filing a claim or charge or assisting with an investigation directly with a self-regulatory authority or a government agency or entity, including, but not limited to, the U.S. Equal Employment Opportunity Commission, the National Labor Relations Board, the Department of Justice, the Securities and Exchange Commission, the Congress, any state or local governing authority or agency or entity, and any agency Inspector General (collectively, the “Regulators”), or from making other disclosures that are protected under the whistleblower provisions of state or federal law or regulation. However, to the maximum extent permitted by law, you are waiving your right to receive any individual monetary relief from Xxxx or any others covered by the Waiver and Release resulting from such claims or conduct, regardless of whether you or another party has filed them, and in the event you obtain such monetary relief, Xxxx will be entitled to an offset for the payments made pursuant to this Agreement. This Agreement does not limit your right to receive an award from any Regulator that provides awards for providing information relating to a potential violation of law. You do not need the prior authorization of Xxxx to engage in conduct protected by this Section, and you do not need to notify Xxxx that you have engaged in such conduct.

Nothing in this Agreement, including paragraph 2 above and paragraph 6 below, prevents or prohibits Executive from: (i) filing a claim with a federal, state or local government agency that is responsible for enforcing a law; (ii) making any disclosure of relevant and necessary information or documents in any action, investigation or proceeding relating to this Agreement or as required by law or legal process; or (iii) cooperating, participating, testifying or assisting in any government or regulatory entity investigation or proceeding, including, but not limited to, the Equal Employment Opportunity Commission, a comparable state or local agency, or the SEC; provided, that if any proceeding by any governmental agency is brought on behalf of Executive, or in connection with the claims released herein, to the maximum extent permitted by law, Executive will forego and disclaim any right to monetary relief in any such matter.
