The Guaranteed Savings clause ensures that a specified minimum level of cost savings or financial benefit will be achieved under the terms of an agreement. Typically, this clause applies to contracts involving energy efficiency upgrades, procurement services, or cost-reduction initiatives, where the provider commits to delivering a quantifiable amount of savings to the client. If the promised savings are not realized, the provider may be required to compensate the client for the shortfall. This clause serves to allocate risk and provide assurance to the client that their investment will yield tangible financial results.

Guaranteed Savings. The Owner/Operator has endeavored to provide the ESCO with sufficient general and specific guidance in this ARTICLE 1 to develop the guaranteed savings numbers for the Report. In the event that questions arise as to the calculation of savings or whether certain items will be allowed as savings, the ESCO shall seek written guidance from the Owner/Operator. Owner/Operator rejection of certain calculations of savings or rejection of certain items as allowable savings in the Report shall be at the risk of the ESCO.
Guaranteed Savings. Owner shall:
(a) guaranty annual energy savings as provided in the Form of Written Savings Guarantee attached to this PPA as Exhibit H; and,
(b) provide a performance guarantee in the amount of $2,500 in the form of a performance bond, a cash bond, a letter of credit issued by a bank with a ▇▇▇▇▇'▇ or Standard and Poor's rating of "A" or better or any other surety, including insurance, satisfactory to Host Customer and its approving agency. The guarantee for each year shall be in an amount equal to the amount of the annual guarantee given by the Owner, a qualified provider within the meaning of Section 6-23-2((E) ▇▇▇▇ ▇▇▇▇ in this PPA, which is a guaranteed utility savings contract within the meaning of 6-23-2(D) ▇▇▇▇ ▇▇▇▇.

Guaranteed Savings. The Project will result in energy savings and operational savings as detailed in Exhibit B - Energy Savings Guarantee and Measurement and Verification Plan. Guaranteed Savings. CTS guarantees to CUSTOMER that the identified Facilities will realize the total energy and operational cost avoidance through the combined value of all ECMs over the Term of the contract as defined in Section 1 of Attachment E. In no event shall the savings guarantee provided herein exceed the total installation, maintenance, and financing costs for the Work under this Agreement. Notwithstanding any other provision of this Agreement required savings reconciliation or verification, the Total Guarantee Year Savings in each Guarantee Year are stipulated and agreed to by both parties to this Agreement to equal the Energy Costs and Operational Cost Avoidance amounts set forth in Attachment E (Schedule of Savings), and shall be deemed realized upon the date of final Project Acceptance.
Guaranteed Savings. HONEYWELL guarantees to CUSTOMER that the identified Facilities will realize the annual Guaranteed Savings through the combined contribution of all ESMs in each and every Guarantee Year during the Guarantee Term. Energy Savings shall be identified in native energy units for each ESM (kWh, therms, gallons etc).
Guaranteed Savings. This contract is governed under Wisconsin State Statute 66.0133 which requires the Contractor to guarantee the energy savings that the project will produce. In this contract the FEMP IPMVP protocol used will be Option A – Retrofit Isolation. The values calculated using IPMVP Option A will be calculated by the district and shared with the contractor. The resulting values will be used to create the stipulated values for each Facility Improvement Measure. These Stipulated values will be agreed to with the district and the contractor and will then be deemed to guarantee.
