Hardware Warranties. Cohesity warrants that Cohesity Platforms and/or each hardware component thereof will be free from material defect in workmanship (under normal use and conditions) for one (1) year from the date of purchase. This warranty does not apply to (a) expendable or consumable parts, (b) any software contained on the Products or otherwise supplied by Cohesity, (c) Products which are returned in any manner that is not in compliance with Cohesity’s then-current RMA policies, (d) any Product from which the serial number has been removed, or (e) any Product that has been damaged or rendered defective for any reason other than caused by Cohesity or a Cohesity-authorized service provider.

Hardware Warranties. If, in conjunction with Customer’s licensure of Licensed Product, Customer is purchasing any hardware through Pearson, Customer acknowledges that such hardware purchase is being facilitated by Pearson as an accommodation to Customer only. The warranties on any hardware not manufactured by Pearson will be limited to those provided by the manufacturers of such hardware and/or the vendors through which such hardware is being supplied. Pearson will pass through any manufacturer’s or other vendor’s warranty to the extent permitted by the manufacturer or other vendor, as applicable. Customer agrees to look solely to the applicable manufacturer or other vendor, and not to Pearson, to fulfill any such warranties and any maintenance, repair, or other service obligations related to such hardware. Customer further agrees that any claims related to any such hardware, whether for breach of warranty or otherwise, must be made directly against the applicable manufacturer or other vendor, and not against Pearson, and that Pearson shall have no liability whatsoever in connection with such claims.
Hardware Warranties. Hardware warranties may be extended through a separate Extended Hardware Warranty, ordered in accordance with Section 1. Renewal of this Master Agreement and the License and Support Subscription do not, in themselves, extend hardware warranties.

Hardware Warranties. 11.1 VARISCITE warrants to Buyer that VARISCITE’s Products are free from defects in material and workmanship, under normal use and service. Buyer shall promptly notify VARISCITE in writing of any malfunction in any Products under Warranty, which notification and return to VARISCITE of Product under Warranty shall be pursuant to VARISCITE’s prevailing Return Merchandise Authorization (RMA) request to be submitted at xxxxx://xxxxxxxxxxxxxxx.xxxxxxx.xxx/login. VARISCITE’s obligation under this warranty shall be limited to replacement or repair of Products, free of charge, EXW point of manufacture for which a defect has been substantiated by VARISCITE, for a period of twelve (12) months from date of Product shipment from VARISCITE to Buyer. 11.2 VARISCITE warrants no Product defect that results from improper use, negligence, modification, improper installation, improper product testing methods, repairs made by the Buyer, or other factors outside of VARISCITE’s control. 11.3 Removal of the unique serial number adhesive label on hardware Products shall void any warranty. 11.4 VARISCITE makes no warranty for Products furnished, but not manufactured by VARISCITE, which Products shall be covered by the warranty of the original manufacturer. 11.5 VARISCITE does not warrant the sale of used or reconditioned hardware. 11.6 THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, GUARANTIES OR LIABILITY ARISING BY LAW OR OTHERWISE, (INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND CONSEQUENTIAL DAMAGES.)

Hardware Warranties. Red River warrants that the product portion of the Services (“Hardware”) Customer purchases from Red River will be new and free from material defects. Red River will, to the extent it is allowed by its vendors or the manufacturers, pass through any warranties and indemnifications provided by the manufacturer of the Hardware.
