HISTORICALLY IRRIGATED ACREAGE RIGHT. 5.1.1.1. Subject to the other provisions of this Settlement Agreement, the Pueblo shall be entitled to divert and consume the surface waters of the Taos Valley Stream System to irrigate the five thousand seven hundred twelve and seventy- eight hundredths (5,712.78) acres shown on the Taos Pueblo Water Use Survey. Such right shall have an Aboriginal Priority Date. In exercising this right, the Pueblo shall be entitled to:

  • Built-up Area The built-up area for the Designated Apartment or any other Unit shall mean the Carpet Area of such Unit and Balcony area and 50% (fifty percent) of the area covered by those external walls which are common between such Unit/Balcony and any other Unit/Balcony and the area covered by all other external walls of the such Unit/Balcony.

  • ENCROACHMENT/ACQUISITION The Assignee/Bank has no notice or knowledge of any encroachment or that the Government or any other authority has any immediate intention of acquiring the whole or any part of the Property for roads or any other improvement schemes and if such encroachment shall be found to exist or if the Government or any local authority has any such intention, the same shall not annul the sale or shall any abatement or compensation be allowed in respect thereof.
