Common use of Holder Not a Stockholder Clause in Contracts

Holder Not a Stockholder. Prior to the exercise of this Warrant as hereinbefore provided, the Holder hereof shall not, by virtue of its ownership of this Warrant, except as specifically provided herein, be entitled to any of the rights of a stockholder of the Company including, without limitation, the right as a stockholder to (a) vote on or consent to any proposed action of the Company or (b) receive notice of or attend any meetings of stockholders of the Company or notice of any other proceedings of the Company.
