Common use of IDLC Hybrid Loops Clause in Contracts

IDLC Hybrid Loops. Notwithstanding any other provision of the Amended Agreement (but subject to and without limiting Section 2 above and Section 4.4 below), if RNK requests, in order to provide narrowband services, unbundling of a 2 wire or 4 wire Loop currently provisioned via Integrated Digital Loop Carrier (over a Hybrid Loop), Verizon shall, in accordance with 47 C.F.R. § 51.319(a) and the Arbitration Orders, provide RNK unbundled access to a Loop capable of voice-grade service to the end user customer served by the Hybrid Loop. 3.2.4.1 Verizon will endeavor to provide RNK with an existing copper Loop or a Loop served by existing Universal Digital Loop Carrier (“UDLC”). Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNK. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNK’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. If the order is cancelled by RNK after construction work has started, RNK shall be responsible for cancellation charges and a pro-rated charge for construction work performed prior to the cancellation. 3.2.4.3 Verizon may exclude its performance in connection with providing unbundled Loops pursuant to this Section 3.2.4 from standard provisioning intervals and performance measures and remedies, if any, contained in the Amended Agreement or elsewhere, until such time as a legally effective order of the Department requires new standard provisioning intervals and/or performance measures and remedies for Verizon’s provisioning of unbundled Loops pursuant to this Section 3.2.4, at which time such new intervals, performance measures, and/or remedies shall apply to the extent and for so long as they remain effective.

In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK AT&T shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK AT&T requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKAT&T’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. If the order is cancelled by RNK AT&T after construction work has started, RNK AT&T shall be responsible for cancellation charges and a pro-rated charge for construction work performed prior to the cancellation. 3.2.4.3 Verizon may exclude its performance in connection with providing unbundled Loops pursuant to this Section 3.2.4 from standard provisioning intervals and performance measures and remedies, if any, contained in the Amended Agreement or elsewhere, until such time as a legally effective order of the Department requires new standard provisioning intervals and/or performance measures and remedies for Verizon’s provisioning of unbundled Loops pursuant to this Section 3.2.4, at which time such new intervals, performance measures, and/or remedies shall apply to the extent and for so long as they remain effective.

In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK ***CLEC Acronym TXT*** shall be responsible for the following chargescharges to the extent provided for in the Pricing Attachment to this Amendment[; provided, which shall be determined on a case-by-case basis and however, that the following charges shall apply even if such charges are not provided for in the Pricing Attachment to this AmendmentAmendment in cases where Verizon offers, and ***CLEC Acronym TXT*** requests, construction of the necessary copper Loop or UDLC facilities] [ only if RNK ***CLEC Acronym TXT*** requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access]: (a) an engineering query charge for preparation of a price quote; (b) upon RNK***CLEC Acronym TXT***’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. Verizon shall provide the requesting CLEC with the choice of the most cost effective option that is most technically feasible. If Verizon, in its sole discretion, Verizon offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall shall, upon request of RNK, construct such the necessary copper Loop or UDLC facilities upon request of RNKfacilities. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNK’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. RCN-B. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK RCN-B shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK RCN-B requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKRCN-B’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. If the order is cancelled by RNK RCN-B after construction work has started, RNK RCN-B shall be responsible for cancellation charges and a pro-rated charge for construction work performed prior to the cancellation. 3.2.4.3 Verizon may exclude its performance in connection with providing unbundled Loops pursuant to this Section 3.2.4 from standard provisioning intervals and performance measures and remedies, if any, contained in the Amended Agreement or elsewhere, until such time as a legally effective order of the Department requires new standard provisioning intervals and/or performance measures and remedies for Verizon’s provisioning of unbundled Loops pursuant to this Section 3.2.4, at which time such new intervals, performance measures, and/or remedies shall apply to the extent and for so long as they remain effective.

Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNKConversent. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK Conversent shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK Conversent requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKConversent’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. If the order is cancelled by RNK Conversent after construction work has started, RNK Conversent shall be responsible for cancellation charges and a pro-pro- rated charge for construction work performed prior to the cancellation. 3.2.4.3 Verizon may exclude its performance in connection with providing unbundled Loops pursuant to this Section 3.2.4 from standard provisioning intervals and performance measures and remedies, if any, contained in the Amended Agreement or elsewhere, until such time as a legally effective order of the Department requires new standard provisioning intervals and/or performance measures and remedies for Verizon’s provisioning of unbundled Loops pursuant to this Section 3.2.4, at which time such new intervals, performance measures, and/or remedies shall apply to the extent and for so long as they remain effective.

IDLC Hybrid Loops. Notwithstanding any other provision of the Amended Agreement (but subject to and without limiting Section 2 above and Section 4.4 below), if RNK IDT requests, in order to provide narrowband services, unbundling of a 2 wire or 4 wire Loop currently provisioned via Integrated Digital Loop Carrier (over a Hybrid Loop), Verizon shall, in accordance with 47 C.F.R. § 51.319(a) and the Arbitration Orders, provide RNK IDT unbundled access to a Loop capable of voice-grade service to the end user customer served by the Hybrid Loop. 3.2.4.1 Verizon will endeavor to provide RNK IDT with an existing copper Loop or a Loop served by existing Universal Digital Loop Carrier (“UDLC”). Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNKIDT. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK IDT shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK IDT requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKIDT’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. Notwithstanding any other provision of the Amended Agreement (but subject to and without limiting Section 2 above and Section 4.4 below), if RNK XO requests, in order to provide narrowband services, unbundling of a 2 wire or 4 wire Loop currently provisioned via Integrated Digital Loop Carrier (over a Hybrid Loop), Verizon shall, in accordance with 47 C.F.R. § 51.319(a) and the Arbitration Orders, provide RNK XO unbundled access to a Loop capable of voice-grade service to the end user customer served by the Hybrid Loop. 3.2.4.1 Verizon will endeavor to provide RNK XO with an existing copper Loop or a Loop served by existing Universal Digital Loop Carrier (“UDLC”). Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNKXO. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK XO shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK XO requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKXO’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNKSpectrotel. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK Spectrotel shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK Spectrotel requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKSpectrotel’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. If the order is cancelled by RNK after construction work has started, RNK shall be responsible for cancellation charges and a pro-rated charge for construction work performed prior to the cancellation. 3.2.4.3 Verizon may exclude its performance in connection with providing unbundled Loops pursuant to this Section 3.2.4 from standard provisioning intervals and performance measures and remedies, if any, contained in the Amended Agreement or elsewhere, until such time as a legally effective order of the Department requires new standard provisioning intervals and/or performance measures and remedies for Verizon’s provisioning of unbundled Loops pursuant to this Section 3.2.4, at which time such new intervals, performance measures, and/or remedies shall apply to the extent and for so long as they remain effective.and

In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK ANTC shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK ANTC requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKANTC’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. If the order is cancelled by RNK ANTC after construction work has started, RNK ANTC shall be responsible for cancellation charges and a pro-rated charge for construction work performed prior to the cancellation. 3.2.4.3 Verizon may exclude its performance in connection with providing unbundled Loops pursuant to this Section 3.2.4 from standard provisioning intervals and performance measures and remedies, if any, contained in the Amended Agreement or elsewhere, until such time as a legally effective order of the Department requires new standard provisioning intervals and/or performance measures and remedies for Verizon’s provisioning of unbundled Loops pursuant to this Section 3.2.4, at which time such new intervals, performance measures, and/or remedies shall apply to the extent and for so long as they remain effective.

Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNKMetTel. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK MetTel shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK MetTel requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKMetTel’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNKTCG. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK TCG shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK TCG requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKTCG’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. If the order is cancelled by RNK TCG after construction work has started, RNK TCG shall be responsible for cancellation charges and a pro-rated charge for construction work performed prior to the cancellation. 3.2.4.3 Verizon may exclude its performance in connection with providing unbundled Loops pursuant to this Section 3.2.4 from standard provisioning intervals and performance measures and remedies, if any, contained in the Amended Agreement or elsewhere, until such time as a legally effective order of the Department requires new standard provisioning intervals and/or performance measures and remedies for Verizon’s provisioning of unbundled Loops pursuant to this Section 3.2.4, at which time such new intervals, performance measures, and/or remedies shall apply to the extent and for so long as they remain effective.

Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNKACN. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK ACN shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK ACN requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKACN’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. If the order is cancelled by RNK ACN after construction work has started, RNK ACN shall be responsible for cancellation charges and a pro-rated charge for construction work performed prior to the cancellation. 3.2.4.3 Verizon may exclude its performance in connection with providing unbundled Loops pursuant to this Section 3.2.4 from standard provisioning intervals and performance measures and remedies, if any, contained in the Amended Agreement or elsewhere, until such time as a legally effective order of the Department requires new standard provisioning intervals and/or performance measures and remedies for Verizon’s provisioning of unbundled Loops pursuant to this Section 3.2.4, at which time such new intervals, performance measures, and/or remedies shall apply to the extent and for so long as they remain effective.

In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK Level 3 shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK Level 3 requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKLevel 3’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNKEqual Access. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK Equal Access shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK Equal Access requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKEqual Access’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. If the order is cancelled by RNK Equal Access after construction work has started, RNK Equal Access shall be responsible for cancellation charges and a pro-rated charge for construction work performed prior to the cancellation. 3.2.4.3 Verizon may exclude its performance in connection with providing unbundled Loops pursuant to this Section 3.2.4 from standard provisioning intervals and performance measures and remedies, if any, contained in the Amended Agreement or elsewhere, until such time as a legally effective order of the Department requires new standard provisioning intervals and/or performance measures and remedies for Verizon’s provisioning of unbundled Loops pursuant to this Section 3.2.4, at which time such new intervals, performance measures, and/or remedies shall apply to the extent and for so long as they remain effective.

IDLC Hybrid Loops. Notwithstanding any other provision of the Amended Agreement (but subject to and without limiting Section 2 above and Section 4.4 belowabove), if RNK SPRINT requests, in order to provide narrowband services, unbundling of a 2 wire analog or 4 wire analog Loop currently provisioned via Integrated Digital Loop Carrier (over a Hybrid Loop), Verizon shall, in accordance with as and to the extent required by 47 C.F.R. § 51.319(a) and the Arbitration Orders), provide RNK SPRINT unbundled access to a Loop capable of voice-grade service to the end user customer served by the Hybrid Loop. 3.2.4.1 Verizon will endeavor to provide RNK SPRINT with an existing copper Loop or a Loop served by existing Universal Digital Loop Carrier (“UDLC”). Standard recurring and non-recurring Loop charges will apply. In addition, subject to Section 3.2.4.3 below, a non- recurring charge will apply whenever a line and station transfer is performed. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible optionshall, such as any technically feasible option identified in note 855 upon request of the TROSPRINT, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing construct the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNK. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK SPRINT shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKSPRINT’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote. If the order is cancelled by RNK SPRINT after construction work has started, RNK SPRINT shall be responsible for cancellation charges and a pro-rated charge for construction work performed prior to the cancellation. 3.2.4.3 The charges described in this section 3.2.4 shall be subject to the provisions set forth in Section 1 of the Pricing Attachment to this Amendment. 3.2.4.4 Verizon may exclude its performance in connection with providing unbundled Loops pursuant to this Section 3.2.4 from standard provisioning intervals and performance measures and remedies, if any, contained in the Amended Agreement or elsewhere, until such time as a legally effective order of the Department expressly requires new standard provisioning intervals and/or performance measures and remedies for Verizon’s provisioning of unbundled Loops pursuant to this Section 3.2.4, at which time such new intervals, performance measures, and/or remedies shall apply to the extent and for so long as they remain effective.

IDLC Hybrid Loops. Notwithstanding any other provision of the Amended Agreement (but subject to and without limiting Section 2 above and Section 4.4 below), if RNK Qwest requests, in order to provide narrowband services, unbundling of a 2 wire or 4 wire Loop currently provisioned via Integrated Digital Loop Carrier (over a Hybrid Loop), Verizon shall, in accordance with 47 C.F.R. § 51.319(a) and the Arbitration Orders, provide RNK Qwest unbundled access to a Loop capable of voice-grade service to the end user customer served by the Hybrid Loop. 3.2.4.1 Verizon will endeavor to provide RNK Qwest with an existing copper Loop or a Loop served by existing Universal Digital Loop Carrier (“UDLC”). Standard recurring and non-recurring Loop charges will apply. 3.2.4.2 If neither a copper Loop nor a Loop served by UDLC is available, then Verizon shall offer to provision a Loop by constructing the necessary copper Loop or UDLC facilities or such other technically feasible option, such as any technically feasible option identified in note 855 of the TRO, that Verizon in its sole discretion may determine to offer. If Verizon, in its sole discretion, offers to provision a Loop by constructing the necessary copper Loop or UDLC facilities, then Verizon shall construct such copper Loop or UDLC facilities upon request of RNKQwest. In addition to the rates and charges payable in connection with any unbundled Loop so provisioned by Verizon, RNK Qwest shall be responsible for the following charges, which shall be determined on a case-by-case basis and shall apply even if such charges are not provided for in the Pricing Attachment to this Amendment, only if RNK Qwest requests the construction of a copper Loop or UDLC facilities when Verizon has proposed to provide a different less costly method of technically feasible access: (a) an engineering query charge for preparation of a price quote; (b) upon RNKQwest’s submission of a firm construction order, an engineering work order nonrecurring charge; and (c) construction charges, as set forth in the price quote.
