Immediate dismissal. No prior disciplinary written warning shall be necessary for discharge or suspension if the cause for the disciplinary action is sufficiently serious in the judgment of the District to require immediate action, to include theft, intoxication on the job, verified use of controlled substance(s) in violation of Board policy for safety sensitive positions, gross maltreatment or gross neglect of a child, gross negligent use of District vehicles or safety violations. The District will observe its customary due process procedure and investigation in meeting with the employee prior to discharge or suspension without pay. Every effort will be made to protect the confidentiality of the employee during the investigation.
Immediate dismissal. 12.2.1 The Company may by written notice terminate the Employment without notice or pay in lieu of notice if the Executive:
(a) commits any act of gross misconduct or is guilty of any conduct which may in the reasonable opinion of the Board, bring the Company into disrepute or is calculated or likely prejudicially to affect the interests of the Company, whether or not the conduct occurs during or in the context of the Executive’s Employment;
(b) is convicted of any criminal offence punishable with imprisonment (other than an offence under road traffic legislation in the United Kingdom or elsewhere for which he is not sentenced to any term of imprisonment whether immediate or suspended);
(c) commits any act of dishonesty relating to the Company, any of its employees or otherwise;
(d) commits a material breach of the terms and conditions of this Agreement or repeats or continues (after a written warning) any other breach of such terms and conditions, including any failure to carry out the Duties efficiently, diligently or competently;
(e) becomes prohibited by law from being a director, is removed from office pursuant to the Company’s articles of association, or, except at the request of the Company or pursuant to clause 12.7.1, resigns as a director;
(f) becomes of unsound mind or a patient within the meaning of the Mental Health Xxx 0000 so that in the opinion of the Board he is unable to perform the Duties;
(g) becomes bankrupt or makes any arrangement or composition with his creditors generally; or
(h) is the subject of or causes the Company to be the subject of a penalty or reprimand imposed by any regulatory authority by which the Company is governed or to which its activities are subject.
Immediate dismissal. The Company may by notice terminate this Agreement with immediate effect if the Executive:
15.3.1 commits any act of gross misconduct or repeats or continues (after written warning) any other material breach of his obligations under this Agreement; or
15.3.2 is responsible for any conduct which in the reasonable and fair opinion of the Board brings him, the Company or any Group Company into disrepute; or
15.3.3 is convicted of any criminal offence (excluding an offence under road traffic legislation in the United Kingdom or elsewhere for which he is not sentenced to any term of imprisonment whether immediate or suspended); or
15.3.4 commits any act of dishonesty whether relating to the Company, any Group Company, any of its or their employees or otherwise; or
15.3.5 becomes bankrupt or makes any arrangement or composition with his creditors generally; or
15.3.6 is in the reasonable and fair opinion of the Board incompetent in the performance of his duties.
Immediate dismissal. An employee may be dismissed immediately for the following reasons:
Immediate dismissal. At the discretion of the County Court and the department head, the following actions by an employee may be grounds for immediate dismissal:
A. Drinking of alcoholic beverages while on duty or while in County equipment;
B. Malicious destruction of County property;
C. Theft of County property;
D. Intentional falsification of application for employment and/or County records (including job duty records). The above is only an example of causes for immediate dismissal and is not intended to limit the County's right to terminate for serious misconduct and the employee retains all due process rights provided by this agreement.
Immediate dismissal. 16.2.1 The Company may by written notice terminate the Employment without notice or pay in lieu of notice if the Executive:
16.2.1.1 commits any act of gross misconduct or is guilty of any conduct which may in the reasonable opinion of the Board, bring the Company into disrepute or is calculated or likely prejudicially to affect the interests of the Company, whether or not the conduct occurs during or in the context of the Executive’s Employment;
16.2.1.2 is convicted of any criminal offence punishable with imprisonment (other than an offence under road traffic legislation in the United Kingdom or elsewhere for which he is not sentenced to any term of imprisonment whether immediate or suspended); or
16.2.1.3 commits any act of dishonesty relating to the Company, any of its employees or otherwise;
16.2.1.4 commits a material breach of the terms and conditions of this Agreement or repeats or continues (after a written warning) any other breach of such terms and conditions, including any failure to carry out the Duties efficiently, diligently or competently;
16.2.1.5 becomes of unsound mind or a patient within the meaning of the Mental Health Xxx 0000 so that in the opinion of the Board he is unable to perform the Duties; or
16.2.1.6 becomes bankrupt or makes any arrangement or composition with his creditors generally.
Immediate dismissal. The Company may terminate this Agreement with immediate effect if the Executive:
16.1.1 commits any act of gross misconduct or repeats or continues (after written warning) any other serious breach of his obligations under this Agreement; or
16.1.2 is convicted of any criminal offence punishable with 6 months or more imprisonment (excluding an offence under road traffic legislation in the United Kingdom or elsewhere for which he is not sentenced to any term of imprisonment whether immediate or suspended); or
16.1.3 becomes bankrupt or makes any arrangement or composition with his creditors generally.
Immediate dismissal. The Company may by notice terminate this Agreement with immediate effect if the Executive:
17.3.1. commits any act of gross misconduct or repeats or continues (after written warning) any other serious breach of his obligations under this Agreement; or
17.3.2. is guilty of any conduct which in the reasonable opinion of the Board of the Parent brings him, or the Company or its Associated Companies into disrepute; or
17.3.3. is convicted of any criminal offence punishable with more than six months imprisonment (other than an offence under road traffic legislation in the United Kingdom or elsewhere in respect of which he is convicted and is sentenced to an immediate term of imprisonment); or
17.3.4. commits any act of dishonesty whether relating to the Company, any of its or their employees or otherwise; or
17.3.5. when he is a Director of the parent, becomes bankrupt or makes any arrangement or composition with his creditors generally; or
17.3.6. is in the reasonable opinion of the Board of the parent incompetent in the performance of his duties.
Immediate dismissal. Without prejudice to any remedy which the Company may have against Dr Jhoti for breach or non-performance of any of the provisions of this Agreement the Company may by written notice to Dr Jhoti forthwith terminate this Agreement, and it will be treated for the purposes of this Agreement as termination by the Company ‘for cause’, if Dr Jhoti: -
Immediate dismissal. The Company may with immediate effect terminate this Agreement if the Executive:
11.3.1 commits any act of gross misconduct or repeats or continues (after written warning) any other material or serious breach of his obligations under this Agreement; or
11.3.2 is guilty of any conduct which in the reasonable opinion of the Board brings him or the Company or any Group Company into serious disrepute; or
