Importer Security Filing. Seller shall provide Buyer or Buyer’s designated agent in a timely fashion with all the data required to enable Buyer’s compliance with the U.S. Customs’ Importer Security Filing regulation, see 19 CFR Part 149 (the “ISF Rule”) for all of Seller’s ocean shipments of goods to Buyer destined for or passing through a U.S. port. Seller hereby Covenants to provide Buyer or Buyer’s designated agent with accurate “Data Elements” as defined in and required by the ISF Rule in a timely fashion to ensure Buyer or Buyer’s designated agent has sufficient opportunity to comply with its filing obligations thereunder.

Importer Security Filing. Seller shall provide Buyer or Buyer’s designated agent in a timely fashion with all the data required to enable Buyer’s compliance with the U.S. Customs’ Importer Security Filing regulation, see 19 CFR Part 149 (the “ISF Rule”) for all of Seller’s ocean shipments of goods to Buyer destined for or passing through a U.S. port. Seller hereby Covenants to provide Buyer or Buyer’s designated agent with accurate “Data Elements” as defined in and required by the ISF Rule and, in the case of goods to be imported into Canada, all Advance Commercial Information requirements of the Canada Border Services Agency, in a timely fashion to ensure Buyer or Buyer’s designated agent has sufficient opportunity to comply with its filing obligations thereunder.
Importer Security Filing. Seller agrees to provide Buyer or Xxxxx’s agent with timely, accurate, and complete information with respect to all Products purchased or shipped pursuant to this Agreement as required for compliance with all applicable import regulations, including without limitation the Importer Security Filing (“10+2”) regulation issued by U.S.
Importer Security Filing. For all shipments which are made by vessel into the United States of America, U.S. Customs and Border Protection requires that an Importer Security Filing (ISF) be filed no later than 24 hours before the cargo is laden aboard the vessel at the foreign port (see 19 C.F.R. §149.2). Importer Security Filing. When Buyer is serving as Importer of Record for goods being transported to the United States via ocean shipment, Seller will timely and accurately supply all data elements necessary to the Importer Security Filing as required by US Customs. Importer Security Filing. Seller agrees to provide Buyer or Xxxxx’s agent with timely, accurate, and complete information with respect to all goods purchased or shipped pursuant to this Agreement as required for compliance with all applicable import regulations, including without limitation the Importer Security Filing (“10+2”) regulation issued by U.S. Customs and Border Protection. Xxxxxx agrees to indemnify and hold Buyer harmless from and against all transportation-, detention-, or storage-related charges or fees and any government-assessed fees or penalties that Buyer incurs as a result of Seller’s failure to provide the required information in a timely, accurate or complete manner.
Importer Security Filing. Vendor shall be responsible for the timely submission of Importer Security Filing information (“ISF”) as required by CBP. Timely filing will be no less than four days prior to goods being laden on board the vessel at the origin port. Vendor shall be held responsible for any and all claims (including third party claims), demands, liabilities, losses, damages, fines, assessments, judgments, penalties, costs and expenses and storage and drayage imposed by CBP, arising out of or relating to any inaccurate, incomplete or untimely submission or failure to submit the ISF. Importer Security Filing. Seller agrees to provide Purchaser with timely, accurate and complete information with respect to all goods purchased from Seller as required for compliance with all applicable regulations, e.g., the Importer Security Filing issued by U.S. Customs and Border Protection. Xxxxxx agrees to defend, indemnify, and hold harmless Purchaser from and against all transportation, detention or storage related charges or fees and any government fees or penalties that Purchaser incurs as a result of Seller’s failure to provide said required information.
Importer Security Filing. 36.1. To comply with Importer Security Filing (ISF) Requirements for ocean shipments to the United States, the following data elements shall be sent via electronic mail to the MTU Customs Compliance Office-US at xxxxxxxxxxxxxxx@xxxxxxxxxxxxxx.xxx a minimum of three (3) business days prior to cargo lading: Automated Manifest System (AMS) bill of lading number (lowest level), vessel name, voyage number, cargo lading date, Supplier name and address, XXX’s name & address, Importer of Record number, consignee number, manufacturer (Supplier) name and address, ship-to name and address, container stuffing location name and address, consolidator (stuffer) name and address, and country of origin, harmonized tariff number, and MTU part number of each invoice line item. The ISF pre- alert shall also include invoice(s) for the shipment.
Importer Security Filing. Springs may assess You a penalty and/or liquated damages up to Five Thousand Dollars ($5,000 USD) per violation for failure to provide complete and accurate information required for Importer Security Filing (ʺISFʺ) at least seventy-two (72) business hours prior to the vessel arrival at origin port for ocean shipments. You shall be responsible for contacting Springsʹ assigned forwarder (NYK Logistics) as needed to ensure that all required information is timely provided and all ISF requirements are fulfilled. These obligations apply to all basis of sales except DDP US Destination. Any and all storage charges at the port caused by the delay of information required for ISF shall be paid by You. Tests and Registrations. You, at your sole cost and expense, shall perform, or cause to be performed, all tests on the goods/services required by the Customer Product Safety Commission and any other federal, state and local laws, or the laws of any United States Commonwealth or territory where Springs does business and shall maintain for a period of not less than three (3) years certificates indicating that all applicable tests have been administered and passed. Such tests shall be conducted by a nationally recognized and where required certified testing agency. You shall make available, and at Springs request shall furnish, to Springs copies of such certificates and shall permit Springs or any person or persons authorized by Springs to inspect and make copies of all records maintained by You in connection with such tests. You shall obtain and provide to Springs upon request any and all registration numbers, license numbers, or the like, required by any federal, state, local, foreign, provincial or territorial governmental agency or authority having jurisdiction over the goods type in question, the sale of such goods, and/or any claims made regarding the goods or any of its qualities.
