Incorporated Terms. (a) The terms and provisions of the loan agreement entered into between Explorations and Yankees on April 9, 2002, a copy of which is annexed hereto and made a part hereof as exhibit 1 (the "Loan Agreement"), are hereby incorporated by reference as if here fully set forth.
(b) Any provisions in this Note dealing with a subject or object also dealt with in the Loan Agreement shall, to the extent of any inconsistencies, be deemed to provide Yankees with additional rights and options which will be exercisable in Yankees' sole discretion.

Incorporated Terms all of the terms, requirements, covenants and conditions contained in the Existing Lease except to the extent that they are inconsistent with the clauses written in this lease and with such modifications as are necessary to make them applicable to this lease and the parties to this lease:
Incorporated Terms. Unless otherwise required by the context, the capitalised terms that are used in the Restated Facility Agreement and not defined in these Amendments shall have the same meanings as in the Restated Facility Agreement, as set out in schedule 1 (Definitions of the Facility Agreement) to the Independent Guarantee Agreement.

To the extent there is a conflict between the terms of this Agreement and the CRA or the SOLW Terms, those of this Agreement prevail over the other agreements.
Incorporated Terms. The following terms and conditions set forth in Attachment B to the Letter of Agreement between the Parties dated November 4, 1991 are hereby incorporated by reference: Sections 4, 6, and 8-18. All references in these identified sections to “Letter Agreement” are hereby replaced with “Agreement” and all references to “FCI” or “Buyer” are hereby replaced with “Nextel”.
