Indemnification for Use of Work Product. 4.3.1 If either Design-Builder or Design-Build Subcontractor uses the Work Product on any other project, such party agrees that it shall do so at its sole risk and without liability or legal exposure to the other party, Owner, or anyone working through them. Such party further agrees that it shall defend, indemnify and hold harmless the other party and Owner from and against any and all claims, damages, liabilities, losses and expenses, including attorneys’ fees, arising out of or resulting from such use of the Work Product on another project.
