Independent Nature of Buyers’ Obligations and Rights. Nothing contained herein, and no action taken by Buyer pursuant hereto or in connection herewith, shall be deemed to constitute Buyer and any other holder of the Notes as a partnership, an association, a joint venture or any other kind of entity, or create a presumption that Buyer is in any way acting in concert or as a group with any other holder of the Notes with respect to such obligations. Buyer confirms that it has independently participated in the negotiation of the transaction contemplated hereby with the advice of its own counsel and advisors. [Signature Page Follows]
