Common use of Independent Surveyor Clause in Contracts

Independent Surveyor. The Owners or Developer (as the case may be) and the Council shall jointly appoint and retain at all times during the Preliminary Works and Development up until the end of the Aftercare Period an appropriately experienced Independent Surveyor at the expense of the Owners or Developer (including the appointment of a replacement if the previous Independent Surveyor’s appointment terminates for whatever reason) to perform the role set out in this paragraph 9 of Schedule 1 and in the absence of agreement on the appointment of such surveyor the appointment will be referred to the President of the Royal Institution of Chartered Surveyors who shall nominate the person to be appointed and whose decision shall be final and binding.
