Information Sharing and Confidentiality a. Transmit education records when requested by DCYF within two (2) school days in the following situations: (1) DCYF is conducting an investigation of child abuse and neglect and it is determined by the investigator that education records are relevant to the investigation (RCW 26.44.030). (2) The student has been placed in xxxxxx care, or the court requires a status update including educational information [RCW 28A.150.510; Family Educational Rights and Privacy Act (FERPA), 20.U.S.C. §1232g(b)(1)(L) (Uninterrupted Scholars Act)]. b. Ensure that only persons who have a legitimate educational interest in a student's confidential child welfare information, will have access to information pertaining to students in xxxxxx care. Information shared shall be limited to that which is necessary for providing for the educational success of the student, shall retain its confidentiality, and shall not be further disclosed except as allowed under state and federal law's [RCW 74.04.060; chapter 13.50 RCW; chapter 70.02 RCW; Family Educational Rights and Privacy Act (FERPA); 20U.S.C. §1232g(b)(1)(L) (Uninterrupted Scholars Act); 34 C.F.R. §99].
Information Sharing and Confidentiality. For the purposes of this Agreement, confidential information means the provisions of this Agreement and all information provided in connection with this Agreement which is secret or otherwise not publicly available (in both cases in its entirety or in part) including commercial, financial, marketing or technical information, know- how, trade secrets or business methods, in all cases whether disclosed orally or in writing before or after the date of this Agreement.

In the event a third party makes a request (including, but not limited to, any demand, subpoena, court order or request made pursuant to the Freedom of Information Act or the Privacy Act) for access to or copies of nonpublic information received by one party from the other party, the party receiving the information shall: 1. As soon as practicable, notify the party providing the information of the third party request for such information in writing, including a copy of the request; 2. If the request is made pursuant to the Freedom of Information Act or the Privacy Act, refer, if practicable, such request for material obtained from a providing party back to that providing party for a direct response to the requester. If making such a referral is not practicable, the receiving party shall consult with the providing party in connection with its response to the requestor. 3. If the request is not made pursuant to the Freedom of Information Act or the Privacy Act, before complying with the third party request, consult with the providing party and, to the extent applicable, give the providing party a reasonable opportunity to respond to the demand or request and to assert all reasonable and appropriate legal exemptions or privileges that the party providing the information may request be asserted on its behalf; and 4. Information Sharing and Confidentiality. Consistent with the requirements of FERPA, the LEA will provide information to the CWA relating to the school enrollment and school performance of students in xxxxxx care, including information relating to attendance, grades, and school disciplinary action. Such information sharing ensures that each student’s educational needs are met and also improves the academic outcomes for these students. Pursuant to FERPA, the CWA has the authority to access the student’s information without obtaining consent from the student in question or the student’s parent. The CWA will re-disclose information only to the extent necessary to address the student’s educational needs as provided in FERPA. Pursuant to §1-201(c) of the Human Services Article, all information shared between the Parties is strictly confidential and shall not be re-disclosed, divulged, nor made known to any other party, without appropriate authorization. Violation of this provision is subject to prosecution.
Information Sharing and Confidentiality. 16.1 Subject to Section 16.2, each party agrees that all information obtained hereunder will be the exclusive property of the parties and not publicly disclosed or used other than for the activities contemplated hereunder, except as required by law or by the rules and regulations of any regulatory authority or stock exchange having jurisdiction, or with the written consent of the other parties, such consent not to be unreasonably withheld. 16.2 Consent to disclosure of information pursuant to Section 16.1 will not be unreasonably withheld where a party wishes to disclose any such information to a third party for the purpose of arranging bona fide financings for its contributions to Costs hereunder or for the purpose of selling its Interest, provided that such third party gives its undertaking to the parties that any such information not theretofore publicly disclosed will be kept confidential and not disclosed to others. 16.3 No party will be liable to any other for the fraudulent or negligent disclosure of information by any of its employees, servants or agents, provided that such Participant has taken reasonable steps to ensure the preservation of the confidential nature of such information.
