Information to Participants. Lender may divulge to any participant it may obtain in the Loan, or any portion of the Loan, all information, and furnish to such participant copies of reports, financial statements, certificates, and documents obtained under any provision of this Agreement or any other Loan Document.

Information to Participants. Lender may furnish any financial or other information concerning Borrower, or any of its subsidiaries, heretofore or hereafter provided by Borrower to Lender, pursuant to this Agreement or otherwise, to any prospective or actual purchaser of any participation or other interest in any loans made by Lender to Borrower (whether under this Agreement or otherwise), or to any prospective purchaser of any securities issued or to be issued by Lender.

Information to Participants. Borrower agrees that Lender may furnish any financial or other information concerning Borrower or any of its Subsidiaries heretofore or hereafter provided by Borrower to Lender, pursuant to this Agreement or otherwise, to any prospective or actual purchaser of any participation or other interest in any of the loans made by Lender to Borrower (whether under this Agreement or otherwise), or to any prospective purchaser of any securities issued or to be issued by Lender; provided, however, any such delivery shall be delivered on the condition that such information is delivered on a confidential basis.

Notwithstanding the foregoing, any such participant shall be bound by the restrictions on dissemination of confidential information contained in Section 6.8 above.

Information to Participants. Lender may furnish any financial or other information concerning the Credit Parties or any of their respective subsidiaries, whether provided to Lender pursuant to this Agreement or otherwise, to (a) any prospective or actual purchaser of any participation or other interest in any extensions of credit made by Lender to Borrower (whether under this Agreement or otherwise), (b) any prospective purchaser of any securities issued or to be issued by Lender and/or (c) any prospective lender to Lender.

Information to Participants. (a) The Participating Employer shall distribute, either paper distribution or electronically (ex. Employee portal), benefit communication material as provided by the Third Party Administrator to Participants and Retired Employees within ten (10) days of receipt of such material; and (b) The Participating Employer shall distribute, either paper distribution or electronically (ex. Employee portal), benefit communication material as provided by the Third Party Administrator to all new Participants and to persons who become Retired Employees within ten (10) days from the date of hire or retirement.

Information to Participants. Any notice, statement or other communication required or permitted to be given hereunder to an employee, a Participant or beneficiary of a Participant will be properly given if delivered or mailed, postage prepaid, to the employee, Participant or beneficiary of a Participant at his last post office address shown on the Employer’s records, or if (in the case of an employee) delivered to him at his normal work station. Any notice or other communication from an employee, Participant or beneficiary to the Plan Administrator, the Employer, or the Trustee shall be in such form as may be prescribed by the Plan Administrator and shall be properly given or filed if delivered or mailed by registered or certified mail, postage prepaid, to the Plan Administrator, the Employer or the Trustee, as the case may be, at such address as may be specified from time to time by the Plan Administrator.

Information to Participants. Each Participant shall be provided with such information regarding the Company as the Committee from time to time deems necessary or appropriate; provided that each Participant shall at all times be provided with such information as is required to be provided from time to time pursuant to applicable regulatory requirements, including, but not limited to, any applicable requirements of the Securities and Exchange Commission of the United States and other securities agencies.
