Initial Management of Common Property. The Internal Driveway and Parking, the Internal W alkways and the Common Property, as well as the enforcement of the Rules, Regulations and Restrictions imposed upon the Owners as set out in Schedule “C”, shall be managed and authorized by Calabogie or its nominee until such time as seven of the Units are transferred to the first Owners other than Calabogie. W ithout limiting the generality of the foregoing, during this time Calabogie may designate each Owner’s parking space pursuant to Section 2.3 above. During this time, Calabogie or its nominee shall be entitled to charge to the Owners as a Common Expense a reasonable fee for labour furnished or materials supplied by Calabogie or its nominees, servants or agents (not to exceed the monthly fee set out in Schedule “B” hereto) to manage, maintain, repair and replace the Internal Driveway and Parking, the Internal W alkways and the Common Property as required and, in default of payment on demand, Calabogie shall have the same rights and remedies as set out in Section 4.5 below. Calabogie or its nominee shall perform all of the duties of the Oaks Owners' Committee described below until such time as the Oaks Owners' Committee has been elected. For the purposes of this Agreement, a transfer by Calabogie to itself or any other party for the sole purpose of creating individual titles for the Units shall not be considered to be a transfer of any Unit to the first purchasers.

Initial Management of Common Property. The Common Property shall be managed by West Village until either all of the Units have been sold or West Village wishes to relinquish the management of the Common Property. In computing the cost of maintenance and repair, West Village shall be entitled to charge at the going rate for labour furnished or materials supplied by its servants or agents. When West Village is no longer the manager of the Common Property, the management, supervision and repair of the Common Property shall be exercised by a Co-tenancy Committee. Where specified, West Village as the initial manager of the Common Property prior to the establishment of a Co-tenancy Committee, shall perform those duties set out in section 3.2 herein and shall assume those obligations of the Co- tenancy Committee as detailed and referenced herein.

  • Construction Management Plan Contractor shall prepare and furnish to the Owner a thorough and complete plan for the management of the Project from issuance of the Proceed Order through the issuance of the Design Professional's Certificate of Material Completion. Such plan shall include, without limitation, an estimate of the manpower requirements for each trade and the anticipated availability of such manpower, a schedule prepared using the critical path method that will amplify and support the schedule required in Article 2.1.5 below, and the Submittal Schedule as required in Article 2.2.3. The Contractor shall include in his plan the names and resumés of the Project Superintendent, Project Manager and the person in charge of Safety.

  • Monitoring and Management Information C10.1 The Contractor shall comply with the monitoring arrangements set out in the Monitoring Schedule including, but not limited to, providing such data and information as the Contractor may be required to produce under the Contract.
