Initiating Meetings. A. Request to open negotiations shall be in writing and either sent by certified mail or delivered in person to the receiving party. Board request shall be directed to the President of the Association, and Association request shall be directed to the Superintendent. The initiating party shall file a Notice to Negotiate with the State Employment Relations Board (SERB). B. The initial request calling for negotiations shall be made by either party no later than ninety (90) days prior to the expiration of this Agreement but not prior to one hundred and twenty (120) days before the expiration unless both parties agree. C. Negotiations may be opened earlier in the last year of the Contract by mutual consent of both parties.
