Common use of Insolvency Proceeding Clause in Contracts

Insolvency Proceeding. Any case or proceeding commenced by or against any Person under any provision of any Insolvency Laws, or (b) any proceeding seeking the appointment of any trustee, receiver, liquidator, custodian or other insolvency official with similar powers with respect to such Person or any of its assets, or (c) any proceeding for liquidation, dissolution or other winding up of the business of such Person, or (d) any assignment for the benefit of creditors or any marshalling of assets of such Person.

Insolvency Proceeding. Any case or proceeding commenced by or against any Person under any provision of any Insolvency Laws, or (bii) any proceeding seeking the appointment of any trustee, receiver, interim receiver, liquidator, custodian custodian, monitor or other insolvency official with similar powers with respect to such Person or any of its assets, or (ciii) any proceeding for liquidation, dissolution or other winding up of the business of such Person, or (div) any assignment for the benefit of creditors or any marshalling of assets of such Person.

Insolvency Proceeding. Any any case or proceeding commenced by or against any a Person under any provision of any Insolvency Lawslaw for, or any agreement of such Person to, or any application or petition for the purposes of (a) the entry of an order for relief under any insolvency, debtor relief or debt adjustment law; (b) any proceeding seeking the appointment of any a receiver, trustee, receiver, liquidator, custodian provisional liquidator, administrator, conservator or other insolvency official with similar powers with respect to custodian for such Person or for all or any part of its assets, Property; or (c) any proceeding for liquidation, dissolution an assignment or other winding up of the business of such Person, or (d) any assignment trust mortgage for the benefit of creditors or any marshalling of assets of such Personcreditors.

Any any case or proceeding commenced by or against any a Person under any provision of any Insolvency Lawsstate, federal or foreign law for, or any agreement of such Person to, (a) the entry of an order for relief under the Bankruptcy Code, or any other insolvency, debtor relief or debt adjustment law; (b) any proceeding seeking the appointment of any a receiver, trustee, receiver, liquidator, custodian administrator, conservator or other insolvency official with similar powers with respect to custodian for such Person or any part of its assets, Property; or (c) any proceeding for liquidation, dissolution or other winding up of the business of such Person, or (d) any an assignment for the benefit of creditors or any marshalling of assets of such Personcreditors.
