Instruction to Bidders. 40.1. Contractors shall not engage employees of other contractors presently working in MDL & recorded at Security Dept. The contractor can engage such employee if other contractor gives No Objection Certificate for such engagement & cancel the name of such desirous employee from his roll & accordingly convey to Security. The contractor engaging such employee without permission is liable for penalty including termination of contract & forfeiture of Security Deposit. Such penalty can also be imposed if it is observed that supervisors/ Workers deployed by contractor are not on their roll as per statement submitted by him at Security.
40.2. The bidder / supplier / contractor declares that they being proprietors / directors / partners have not been any time individually or collectively blacklisted or banned or de-listed by any Government or quasi Government agencies or PSUs. If a bidder’s entities as stated above have been blacklisted or banned or de-listed by any Government or quasi Government agencies or PSUs, this fact must be clearly stated and it may not necessarily be a cause for disqualifying him.
40.3. Entry Pass for Contractors and their workmen: Bidders shall comply with the “MDL Security Procedures laid down in MDL for entry passes in respect of Contractors and their workmen” which is available in the home page of OUTSOURCING DEPT. of MDL Website xxx.xxxxxxxx.xx →Tenders → Shipbuilding Outsourcing → SB-OTS Notification
40.4. In the event of placement of order on unregistered vendor, the firm shall apply for registration through Smt. Xxxxx Xxxxxx, CM, SR&R dept., Tel. No. 00000000, within one month from placement of order.
40.5. MDL reserves the right to consider placement of Order / Contract in part or in full against the tendered quantity or reject any or all bids or to cancel the tender without assigning any reason.
40.6. In case of the performance of the contractor is not satisfactory, MDL reserves the right to cancel the order.
40.7. In case of proper on-line filling of Acceptance Formats for ASLA, General conditions of contract (GCC) for Goods & Services, it shall be presumed that all our tender terms & conditions are acceptable to you.

Instruction to Bidders. The Selection of Bidder will be based on Least Cost Selection Method through National Competitive Bidding following Single Stage Two Envelopes bidding procedure.
a) The bid shall be submitted through E-tendering portal under Qualification (Eligibility), Technical and Financial/Commercial envelopes with all the supporting documentary evidence.
b) In the first instance, qualification/technical envelope shall be opened on the E tender portal, and the envelope marked as “Financial Proposal” shall be retained unopened
c) PSDF shall evaluate Technical Proposals in a manner prescribed in section– 03 and 09 (Qualification and Technical Envelope) available on the portal, without reference to the price and shall reject any proposal which does not conform to specified requirements.
d) During the technical evaluation, no amendments to Technical Proposal shall be permitted.
e) After the evaluation and approval of the technical proposals, the financial/commercial envelope (on E-tender portal) shall be opened for technically responsive bids, publicly at a time, date and venue announced and communicated to the bidders in advance, with in the bid validity period.
f) The financial bids found technically non-responsive shall be rejected.
g) Financial (Commercial Envelope) Proposal shall be evaluated based on PSDF’s evaluation
h) Minimum passing marks are 65, a bidder who obtains a minimum of 65 marks or more shall be marked as technically qualified and shall be considered for financial bid opening.
i) The financial proposal of the bids found technically non-responsive shall be retained unopened and shall be returned on the expiry of the grievance period or the decision of the complaint, if any, filed by the non-responsive bidder, whichever is later: provided that the procuring agency may return the sealed financial proposal earlier if the disqualified or non- responsive bidder, contractor or consultant submits an affidavit, through an authorized representative, to the effect that he is satisfied with the proceedings of the procuring agency
j) The lowest evaluated bid shall be awarded the contract
k) This document has different sections carrying information on eligibility, technical evaluation, Scope of work, conditions of tender and form of contract, etc. to assist potential bidders to develop their Technical Proposals.

Instruction to Bidders. 2.1.1. Bidder shall create a process document for carrying out the LABORATORY TESTING from NABL ACCREDITED LABORATORIES and submit the same to ICMR-NITM within 7 days of the award of the contract. This document shall clearly define all the processes to be undertaken by the bidder and standard operating procedures (SOP), the processes involved to meet all the requirements and SLA.
2.1.2. Bidder will provide sufficient resources to fulfill service level requirements and availability as defined in this document.
2.1.3. Bidder shall have to keep the call records updated with applicable call resolution time details, exclusion etc., for all trial site locations in Excel on monthly basis.
2.1.4. Escalation matrix shall be given for the staff and other activities so that backup supports be available.
2.1.5. The selected Company/bidder shall not, without ICMR-NITM’s prior written consent, disclose the contract, or any provision thereof, of any specification, plan sample of information furnished by or on behalf of ICMR-NITM in connection therewith, to any person other than a person employed by the SP in the performance of the contract. Disclosure to any such employed person shall be made in confidence and shall extend only as far as may be necessary for purposes of such performance.
2.1.6. All empaneled companies automatically agree with ICMR-NITM for honoring all aspects of fair-trade practices in executing the work orders placed by ICMR-NITM.
2.1.7. ICMR-NITM will process the bid as per the procedures mentioned in the tender document. It, however, reserves the right to reject any bid without assigning any reason. ICMR-NITM would not be under obligation to give any clarifications to those agencies whose bids have been rejected.
2.1.8. ICMR-NITM reserves the right to modify and amend any of the tender conditions/criteria depending upon Project priorities vis-à-vis urgent commitments. ICMR-NITM also reserves the right to cancel this bid without assigning any reason.

Applicable Standard Terms and Conditions (STC) for applications specifically invited vide Notice Inviting Applications under reference CW-C&M- VENDOR ENLISTMENT dated 20.10.2016 for consultancy services group enlistment CSG-01), (CSG-02) and (CSG-03) are contained in STC document reference no. Instruction to Bidders. Bid Proposal The Contractor shall furnish all materials, tools, equipment, labor, and do all work necessary and incidental to completing this Contract, in accordance with the requirements of the documents pertinent thereto, including those listed in Section 104.02 of the Standard Specifications in their entirety, which are also set forth hereinabove. The Contractor shall so complete this Contract and present same to the City on or before the time specified in the Bid Proposal. The total probable estimated cost of the Contract as stated on the Bid is . ($ ). It is agreed that the actual final total cost per item and total Contract may vary in accordance with the provisions of the Bid, Section 102.10 of the Standard Specifications, and Article 4 of the Instructions to Bidders.
Instruction to Bidders. Bidders are advised to study this tender document carefully before participating. It shall be deemed that submission of bid by the bidder has been done after their careful study and examination of the Tender with full understanding to its implications. Any lack of information shall not in anyway relieve the bidder of his responsibility to fulfill his obligations under the Bid.
